GCCs Pause Deputations Amid Tax Bullying
GCCs with $100B forex, 24L jobs, FDI are India’s rising star. Fin Min dragged them to court after Tax Tribunal ruled in GCC favor.
How to Cut the Branch You’re Sitting On?
a. GCCs in India are delivering $98.5B annual forex revenues (FY26), employing 23.6 lakh white collar workers, bringing in fixed capital as FDI, and paying taxes in India.
Over 46% of Fortune 500 firms already operate a GCC in India. It is emerging as the crown jewel of India’s services sector, even as IT industry ($150B revenues) faces de-growth.
b. Employee Deputation (Secondment): The global parent company of a GCC regularly sends its top foreign experts or senior executives to train local teams and transfer tech know-how. These foreign employee deputations are usually for a few months to 1 or 2 years.
c. The Dispute: The GCC in India pays the foreign employee’s salary and expenses while they are deputed in India. The parent company (HQ) sees this as an internal employee expense because no external commercial service is being bought or sold.
d. India’s Revenue Department under the Finance Ministry says that this is not just an internal transfer. It argues that the foreign parent company is a third-party agency providing “technical services” to its Indian unit. So, they demand 18% GST on the services rendered.
e. This tax dispute case began with EY, who won against the Revenue Department as the Income Tax Appellant Tribute (ITAT) ruled in favor of EY. The revenue department then moved the Delhi High Court, which has now reversed the ruling of ITAT, and ruled in favor of FinMin.
f. High Court judgement has created uncertainty for GCCs. Some GCCs have paused FY27 foreign employee deputations as they are worried about getting hit with large tax bills, while others are exploring their options.
g. Tax experts say the bigger risk is if the ruling is upheld and applied more broadly, GCCs in India may be seen as “Permanent Establishments” (PE) for the global parent. That would expose GCCs to 35% tax + surcharge and cess.
Tax Terrorism Hits FDI
a. Vodafone, Cairn Energy, and Vedanta were hit with billions of dollars in retrospective taxes (starting in 2012). All three took India to international arbitration and all three won.
Government of India withdrew retrospective taxation only in 2021 after thorough reputational damage was done and FDI inflows were hit.
b. India’s Net FDI inflows have become negligible in the last five years. Gross FDI inflow in FY26 was a massive @ $95B, but investors pulled out $87B out of India during the same year. So, net FDI was $8B only.
c. India’s problem is not attracting FDI. India’s problem is that it fails to retain FDI. Investors simply pack up, sell their stakes, and take their core capital home (not just repatriate profits).
d. “Net FDI” inflows are still slightly positive only because of the global accounting rule, which says dividends (profit sharing) and royalties (paying the parent for tech/brand) are recorded in the Current Account (not treated as FDI).
e. So, ignoring the accounting entry for a moment, if we calculate everything leaving India (investors pulling out capital + dividends + royalties), then the real balance sheet is as follows:
For every $1 of fresh foreign money entering India, $1.50 is flowing back out.

NOTES:
1. When looking strictly at “fresh cash” inflows, India’s long-term “Real FDI” into manufacturing (not financial FDI, which has nothing to do with nation-building) has actually declined over the above-listed three 4-year periods.
2. RBI has made every tactical move possible to strengthen the Balance of Payments. Even crude prices are back to pre-war levels. Yet, the rupee has made no meaningful recovery.
3. Even with 18% of the world’s population, India’s failure to capture long-horizon foreign capital is the central reason behind India’s loss of economic momentum in recent years.

And the best part is, whom does he blame for all of this?

After Mohan Yadav became Madhya Pradesh CM, his family and real estate companies reportedly bought at least 137 plots spread over 168 acres in and around Ujjain.
This is the same Ujjain being reshaped for Simhastha 2028 with highways, road widening, townships, riverfront projects, medical city, IT park and new commercial zones.
The most damning part is this: out of the 168 acres bought after he became CM, 111 acres are reportedly located along roads announced by CM Mohan Yadav himself.
His family already had land. But after Dec 2023, the land buying saw a sharp jump, right when Ujjain’s development map started turning into a goldmine.
Indian Express repeatedly asked the CM for answers. He stayed silent.

A tale of how the company rewards for loyalty and why its my favorite airlines by miles!
Yesterday when I was flying from Amsterdam to New Delhi, I choose to upgrade myself at the counter because I found the deal to be sweet!
The in counter experience was very mid, these services were being handled by Maharaba and not Air India directly, they didn't have a payment machine to process payment. I had already given my luggage but now I was told that I will have to go to a separate location, pay and come back with the receipt and once I started to go, I was asked to take the luggage with me. I requested, its heavy and will be a long to and fro, but the check in attendant denied stating as per Security protocol it's not allowed.
I acknowledged and took my baggage out, went to the separate area, which was at a different location, paid came back, lost my place in the queue and this time found a different attendant, gave her the receipt
and
she asked which cabin?
I said business and she took that receipt, came back and said
"you will get food of economy".
I asked why wasn't this shared in advance? Or before I paid?
She responded with a straight face, that's the rule.
I again cross questioned, I understand but this is not my first flight with Air India.
She respond, I don't know that's the rule.
For the context, if Air India guys are handling your check in process, they clearly state if pantry is included or not and I have been fortunate enough to have some staff's who have arranged pantry even when it was not available/scarce but all these at their own goodwill and I have always been provided the disclaimer.
It was absent this time, I stopped the argument and understood there's no point talking about this with that person anymore, she isn't even from Air India.
Now once I boarded the flight, Air India's steward Puneet Kapur came to my seat within merely 5 minutes of boarding, greeted me personally and acknowledged the Gold status and asked do let us know if there’s anything I can do for you.
That's when I shared my experience about not being informed about the catering.
He was extremely apologetic, he asked me about when did it happen and said, Mr Sharma, please leave this on me and enjoy the flight. His actual worlds "Sir yeh sb aap mujh par chod do"
Well, he showed me what's customer service is supposed to be, took extremely good care during the flight. Not just him even the other staffs were warm and he made sure to visit in between and check if everything is alright, he most definitely didn't have to but he did.
Kudos @airindia for having staffs like him, please pass on this appreciation to him and pat yourself at back for the amazing experiences you have been giving to me.
I forgot the attendant's name who was catering to me throughout the flight, but even she was a jewel, with such high standards of service.
I have been a fan, loyalist for the longest period and I hope to stay the same. I am confident of Air India's strong future and I will say it, no Airlines values the status as much as Air India does.
How stupid can @united get!? All backpacks under the seat is stupid and a flight safety risk...Think of an emergency evacuation and all straps getting in peoples feet. Come on guys ..wake up
