A similar thing happened when Gordon J was part of a 2014 Federal Court decision on bank fees, and was promoted to the High Court before the appeal. She did not sit in that 2016 hearing (which overturned her judgment).
Justice Jagot awarded a famous victory to ABC journalist Steve Cannane in the recent Chelmsford defamation case, that was subsequently overturned by full Federal Court. Could she get another bite at it in the High Court? That would be interesting!
