دیوان عالی کشور رای اعدام بنیامین نقدی به اتهام افساد فی‌الارض را تایید کرد

مصطفی نیلی، وکیل بنیامین نقدی، اعلام کرد که شعبه ۴۱ دیوان عالی کشور حکم اعدام موکلش را به اتهام «افساد فی‌الارض» تایید کرده است.

او در گفت‌وگو با «امتداد» گفت این رای روز گذشته به وکلای پرونده ابلاغ شده و افزود: «به‌زودی نسبت به این رای درخواست اعاده دادرسی خواهیم کرد. با توجه به اینکه هیچ آسیبی به کسی وارد نشده است، امیدواریم با پذیرش اعاده دادرسی، امکان رسیدگی مجدد به پرونده در شعبه هم‌عرض فراهم شود.»

بنیامین نقدی شامگاه ۱۳ دی‌ماه در شیراز، به دلیل شعله‌ور کردن یک دستگاه کپسول آتش‌نشانی به سمت ماموران نیروی انتظامی، بازداشت شد.

در ابتدا اتهام «شروع به قتل» به او تفهیم شد، اما این اتهام بعداً به «محاربه» تغییر یافت.

پس از پایان تحقیقات مقدماتی، کیفرخواست او با اتهام‌های «محاربه»، «عضویت در گروه‌های برهم‌زننده امنیت کشور»، «اجتماع و تبانی به قصد ارتکاب جرم علیه امنیت کشور» و «فعالیت تبلیغی علیه نظام» صادر شد. در مقابل، درباره اتهام‌های «ایراد صدمه جسمانی به ماموران» و «حمل سلاح سرد» قرار منع تعقیب صادر شد.

با این حال، قضات شعبه اول دادگاه انقلاب شیراز تمامی اتهام‌های مطرح‌شده را از مصادیق «افساد فی‌الارض» تشخیص داده و بر همین اساس، حکم اعدام بنیامین نقدی را صادر کردند؛ حکمی که اکنون از سوی شعبه ۴۱ دیوان عالی کشور نیز تایید شده است.
