In the multiverse, there is a universe where AKO BIKOL Partylist does not exist and Zaldy Co and Kito Co did not become Congressmen.

COMELEC Chair Sixto Brilliantes banned Ako Bikol in 2013 but was overruled and overturned by the Supreme Court.

We have only focused on the DPWH and Congress in the unraveling of government corruption.

But the Judiciary, while it may have good intentions and its legal perspective to justify its decisions, is complicit in why corruption happens in the system.

It was the Judiciary that created the main plunderer doctrine that freed Arroyo and made prosecutions for plunder more difficult if not impossible for Enrile, Jinggoy, and Bong Revilla during the pork barrel scam — kaya na acquit sila lahat at si Napoles lang nakakulong.

It was also the Judiciary that allowed premature campaigning of politicians in the landmark case of Peñera vs. COMELEC.

It is also the Judiciary that reversed the long standing practice of the party list system as being reserved only for the marginalized and underrepresented.

Atong Paglaum and Ako Bikol vs COMELEC was the decision that paved the way for Congtractors and Political Dynasties to enter the backdoor of Congress.

Defenders of such decision will point to the Constitution.

But if that’s the case, then it’s high time to change the Constitution so that not only party list system becomes genuine but also that we can ban political dynasties without waiting for Congressmen to pass an enabling law.

The Constitution is almost 40 years old. Do we need a new one?
