A judge in Massachusetts today acquitted a police officer accused of pointing a gun at another officer who then shot her twice.

Kelsey Fitzsimmons was not on duty when Officer Pat Noonan of the North Andover Police Department shot her while serving her with her boyfriend's restraining order, which required her to give him temporary custody of their baby son.

Noonan testified he shot Fitzsimmons because she pointed a gun in his face and pulled the trigger, but Fitzsimmons testified she was pointing the gun at herself, not Noonan. Her lawyer argued Noonan is lying because he knows he shot her unjustifiably.

Fitzsimmons chose to forgo a jury trial and instead have a judge decide whether she's guilty of felony assault with a dangerous weapon.

Judge Jeffrey T. Karp in Essex County Superior Court in Lawrence heard closing arguments this morning and deliberated for about three hours before announcing his verdict.

"Perhaps the Commonwealth could have easily met its burden if the officers had been wearing body cameras.
But under these circumstances, I am left with a reasonable doubt, and I am duty bound to find that the Commonwealth has not met its burden to prove that Ms. Fitzsimmons committed an assault by means of a dangerous weapon on Officer Noonan, and my verdict is and must be, not guilty," the judge said.
