Sadly, she would be convicted for manslaughter if not murder in Nigeria and self defense will not avail her. I know it doesn’t sound fair but that is the law. Self defense is not retaliation. The rape was completed. She killed him after the act—a separate and independent decision was made to kill the deceased.

In Saheed v. The People of Lagos State (2025) 17 NWLR (Pt. 2014) 347, a guy offered to give a lady a ride. While on their way, the guy requested that she give him a blowjob (Oral Sex). This lady refused and resisted the demand. To cut the long story short, she stabbed the guy with a knife she saw inside the car and killed him. Of course, she must have stabbed the guy in self defense but death occurred.

In this case, Supreme Court held that by virtue of section 286 of the Criminal Code Law of Lagos State 2003, when a person is unlawfully assaulted and has not provoked the assault, it is lawful for him to use such force to the assailant as is reasonably necessary to make effectual defence against the assault “provided that the force used is
not intended and is not such as is likely to cause death or grievous harm.”

There is a thin line between retaliation and self defense as a matter of Law. In this case, the court held that self-defense is available only while the threat is ongoing. After the threat has ended, the use of force is no longer
appropriate. This would be considered an act of retaliation.

Indeed, it is difficult to expect a woman who was violated to exercise a high level of patience/restraint not to kill or cause grievous bodily harm to a man who had just raped her. However, without our laws being reviewed in that wise, a woman who was raped may subsequently land in jail when she should be undergoing possible rehabilitation. I don’t want to say our law on self defence is too strict. It should be so because people would kill at any slightest opportunity and rely on self defense. But I believe the law should be reviewed to accommodate instances where the deceased might have put the accused in a situation so severe that they might have killed the deceased as a first adrenaline rush to protect themselves.

Supreme Court was faced with a similar issue in Sunday v. State where a man was convicted for murder because he killed a suspected fulani bandit who initially attempted to kill him on his farm but he later overpowered him and killed him in self defence. It was only Ogunwunmiju JSC that held that self defence should have availed Sunday. Our law makers should read My Lord Judgement and possibly use it as a guide in amending that aspect of Law. People should not land in jail for protecting themselves against evil doers.

Shariah Law is also giving alms to the poor, being kind to your neighbor, praying 5 times a day, etc. Focusing on the punitive aspects (hudūd—which you probably don’t even understand) only, which also exist in every single legal codex, including the constitution, and using it as a gotcha, exposes you for the uneducated, uninformed bigot that you are.
