Jamiat delegation visits Kutch over mosque demolitions, weighs legal options
Seeks meeting with district administration; raises questions over alleged demolition without prior notice*
New Delhi/Bhuj, June 29: A high-level delegation of Jamiat Ulama-i-Hind (JUH) on Monday visited parts of Gujarat's Kutch district where mosques and other structures have recently been demolished, and said it was exploring legal remedies while seeking an explanation from the district administration over the alleged demolition of religious structures without prior notice.
The delegation, led by JUH General Secretary Mohammad Hakeemuddin Qasmi, visited the Juna Kandla Mosque in Gandhidham taluka, which was demolished earlier in the day. According to the organisation, the mosque had been entered in the official Waqf records since 1965 and was known locally for its distinctive architectural features.
During the visit, the delegation met members of the mosque committee, local residents and community representatives before holding consultations with senior advocates and legal experts on the legal options available.
Mohammad Samar, president of the mosque committee, alleged that the mosque was demolished on the morning of June 29 without any prior notice. He claimed that when members of the management sought an explanation from the authorities, they were prevented from approaching the site, removed by police personnel and threatened.
The delegation also stated that the Jama Masjid at Adipur had been demolished during the demolition drive.
According to information, 30 structures have so far been demolished, including 11 religious structures, 17 commercial establishments and two residential houses. The organisation further claimed that 25 youths who protested against the demolition drive had been arrested and sent to jail.
The delegation pointed out that Muslims constitute nearly 35% of the population in Bhuj taluka and around 25% of Kutch district. Given the size of the community, the region is home to hundreds of mosques, shrines and other religious institutions. It said the recent demolitions, created apprehension among residents who fear that additional places of worship could face similar action.
In a statement issued after the visit, the delegation said that where a mosque, shrine or any other religious institution is duly recorded in the Waqf register, any administrative action must be carried out in accordance with the law, the principles of natural justice and constitutional safeguards. It added that matters involving places of worship require strict adherence to due process and sensitivity in view of their religious significance.
The delegation also questioned the rationale behind invoking the area's proximity to the international border, contending that the affected localities are situated well away from the actual border and that the justification cited by the authorities requires legal and administrative scrutiny.
Assuring local residents of legal assistance, the delegation said it would pursue all available legal remedies. It added that it would seek a meeting with the Bhuj district administration before submitting a detailed fact-finding report to JUH president Maulana Mahmood Asad Madani, based on which the organisation would determine its future legal and organisational course of action.
The delegation comprised Maulana Mohammad Hakeemuddin Qasmi, JUH General Secretary; Haji Mohammad Haroon, president of Jamiat Ulama Madhya Pradesh; Atiqur Rahman Qureshi, Organising Secretary of Jamiat Ulama Gujarat; and Maulana Abul Hasan Palanpuri, Organiser of Jamiat Ulama-i-Hind. They were accompanied by local representatives Noor Mohammad Raima, Salimbhai Raima, Mufti Anees, Abdul Karim Bafan and Aneesbhai Qureshi.
Prior to the field visit, a meeting was held in Ahmedabad to review the legal aspects of the matter. It was also attended by Prof. Nisar Ahmad Ansari, State General Secretary of Jamiat Ulama Gujarat, and Advocate Tahir Hakim, among others.

Declaration of the Two-Day Meeting of the Working Committee of Jamiat Ulama-i-Hind:

The current situation in the country, the rising communalism, the silence of constitutional institutions, the increasing measures against Muslims and Islamic symbols, and politics based on hatred are extremely alarming. However, Muslims have never bowed down and will never bow down. They may bow out of love, but they can never be subdued through force, threats, or oppression.

The politics of hatred in the country has now transformed into politics of intimidation, the purpose of which is to frighten Muslims and compel them to live under imposed conditions. For the sake of power, a dangerous game is being played with peace and unity, resulting in a continuous rise in religious extremism and hatred, while the guardians of law remain silent spectators. After the recent elections, the obsession of certain politicians with gaining power through hatred has intensified further, and religious sentiments are being inflamed to pit the majority against the minority, even though governments are run through justice and fairness, not through fear and threats.

In the same way
The statement of the newly elected Chief Minister of West Bengal that he would “work only for Hindus” is completely against constitutional and democratic values, because every Chief Minister takes an oath to uphold justice for all citizens. Those in power are responsible for protecting the constitutional rights of every citizen, not for promoting hatred and divisive politics against any particular community.

In the same way
There is a planned attempt to transform the country into an ideological state. Measures such as the Uniform Civil Code, Making “Vande Mataram” Mandatory, actions against mosques and madrasas, and depriving genuine citizens of voting rights under the guise of SIR are all links in the same chain. Jamiat Ulama-i-Hind will continue its legal and democratic struggle against all such measures.
Previous governments also caused social, educational, political, and economic harm to Muslims, but today the situation has become far more dangerous. Earlier, only Muslims were targeted; now Islam itself has become a target. The laws enacted after 2014 and the recent measures are clear evidence that the present government seeks to harm not only Muslims but Islam as well. At the global level too, organized propaganda is being carried out against Islam. However, history bears witness that those who sought to erase Islam themselves vanished; Islam was alive, remains alive, and will remain alive until the Day of Judgment.

We appeal to all justice-loving parties, social organizations, and patriotic citizens to unite against communal and fascist forces at the democratic and social levels, and to jointly struggle for brotherhood, tolerance, justice, and the supremacy of the Constitution in the country.

जमीयत उलमा-ए-हिंद की कार्यसमिति की दो दिवसीय बैठक का घोषणापत्र ।

देश के वर्तमान हालात, बढ़ती सांप्रदायिकता, संवैधानिक संस्थाओं की चुप्पी, मुसलमानों और इस्लामी प्रतीकों के खिलाफ बढ़ते कदम तथा नफरत आधारित राजनीति अत्यंत चिंताजनक है। हालाँकि मुसलमान न कभी झुका है और न कभी झुकेगा। वह प्रेम से झुक सकता है, लेकिन ताकत, धमकी और अत्याचार के सामने उसे कभी झुकाया नहीं जा सकता।
देश में नफरत की राजनीति अब धमकी की राजनीति में बदल चुकी है, जिसका उद्देश्य मुसलमानों को भयभीत करके उन्हें ���पनी शर्तों पर जीवन बिताने के लिए मजबूर करना है। सत्ता प्राप्ति के लिए अमन और ��कता के साथ खतरनाक खिलवाड़ किया जा रहा है, जिसके परिणामस्वरूप धार्मिक उन्माद और नफरत लगातार बढ़ रही है, जबकि कानून के रखवाले मूकदर्शक बने हुए हैं। हालिया चुनावों के बाद कुछ राजनीतिज्ञों में नफरत के आधार पर सत्ता हासिल करने का चलन और बढ़ गई है तथा बहुसंख्यक समुदाय को अल्पसंख्यकों के विरुद्ध खड़ा करने के लिए धार्मिक भावनाओं को भड़काया जा रहा है, जबकि सरकारें भय और धमकी से नहीं बल्कि न्याय और इंसाफ से चलती हैं।

उसी तरह से
पश्चिम बंगाल के नवनिर्वाचित मुख्यमंत्री का यह बयान कि वे “सिर्फ हिंदुओं के लिए काम करेंगे” संवैधानिक और लोकतांत्रिक मूल्यों के पूरी तरह विरुद्ध है, क्योंकि हर मुख्यमंत्री शपथ लेकर सभी नागरिकों के साथ न्याय करने का संकल्प लेता है। सत्ता में बैठे लोगों की जिम्मेदारी हर नागरिक के स��वैधानिक अधिकारों की रक्षा करना है, न कि किसी विशेष वर्ग के खिलाफ नफरत और विभाजन की राजनीति करना।

उसी तरह से
देश को योजनाबद्ध तरीके से एक वैचारिक राष्ट्र में बदलने की कोशिश की जा रही है। समान नागरिक संहिता, वंदे मातरम् को अनिवार्य बनाना, मस्जिदों और मदरसों के खिलाफ कार्रवाइयाँ तथा एसआईआर की आड़ में वास्तविक नागरिकों को मताधिकार से वंचित करने जैसे कदम इसी सिलसिले की कड़ियाँ हैं। जमीयत उलम��-ए-हिंद इन सभी कदमों के खिलाफ अपनी कानूनी और लोकतांत्रिक लड़ाई जारी रखेगी।

उसी तरह से
पूर्ववर्ती सरकारों ने भी मुसलमानों को सामाजिक, शैक्षिक, राजनीतिक और आर्थिक रूप से नुकसान पहुँचाया, लेकिन आज हालात उससे कहीं अधिक गंभीर हो चुके हैं। पहले केवल मुसलमान निशाने पर थे, अब इस्लाम को भी निशाना बनाया जा रहा है। वर्ष 2014 के बाद बनाए गए कानूनों और हालिया कदमों इस बात का स्पष्ट प्रमाण हैं कि वर्तमान स��कार केवल मुसलमानों ही नहीं बल्कि इस्लाम को भी नुकसान पहुँचाना चाहती है। वैश्विक स्तर पर भी इस्लाम के खिलाफ संगठित प्रचार किया जा रहा है, लेकिन इतिहास गवाह है कि इस्लाम को मिटाने वाले स्वयं मिट गए। इस्लाम ज़िंदा था, ज़िंदा है और क़यामत तक ज़िंदा रहेगा।

हम सभी न्यायप्रिय दलों, सामाजिक संगठनों और देशहित में सोचने वाले नागरिकों से अपील करते हैं कि वे एकजुट होकर सांप्रदायिक और फासीवादी ताकतों का लोकतांत्रिक ���र सामाजिक स्तर पर मुकाबला करें तथा देश में भाईचारा, सहिष्णुता, न्याय और संविधान की सर्वोच्चता के लिए संयुक्त संघर्ष करें।

जमीयत उलेमा-ए-हिन्द के सदर मौलाना अरशद मदनी ने कहा- जो बातें 70 वर्षों में कहने वाले पैदा नहीं हुए थे, आज वो बातें कही जा रही हैं कि बीस करोड़ मुसलमानों की “घर वापसी” कराई जाएगी। ऐसा लगता है मानो सिर्फ उन्हीं लोगों ने अपनी माँ का दूध पिया है, बाकी और किसी ने नहीं। जबकि सच्चाई यह है कि हर वह आवाज़ जो देश को तबाही, बर्बादी, बदअमनी और आपसी दुश्मनी की ओर ले जाए, वह देश के प्रति वफादारी की आवाज नहीं हो सकती।

“वंदे मातरम्” को राष्ट्रीय गीत के रूप में सभी सरकारी कार्यक्रमों, स्कूलों, कॉलेजों और ���योजनों में इसकी समस्त पंक्तियों को अनिवार्य करना केंद्र सरकार का न केवल एक पक्षपाती और ज़बरदस्ती थोपा गया फैसला है, बल्कि यह संविधान में दी गई धार्मिक स्वतंत्रता पर खुला हमला और अल्पसंख्यकों के अधिकार छीनने का न��ंदनीय प्रयास है। मुसलमान किसी को वंदे मातरम् पढ़ने या उसकी धुन बजाने से नहीं रोकते, मगर क्योंकि उसकी कुछ पंक्तियाँ बहुदेववादी आस्था पर आधारित हैं और मातृभूमि को ईश्वर के रूप में प्रस्तुत करती हैं, जो एकेश्वरवादी धर्म की आस्था से टकराती हैं, इसलिए मुसलमान, जो केवल एक अल्लाह की वंदना करता है, उसको इसे पढ़ने पर विवश करना संविधान की धारा 25 और सुप्रीम कोर्ट के फ़ैसलों का खुला उल्लंघन है।

आज इस ग��त को अनिवार्य कर देना और नागरिकों पर थोपने का प्रयास वास्तव में देशप्रेम नहीं, बल्कि चुनावी राजनीति, सांप्रदायिक एजेंडे और जनता का ध्यान मूल समस्याओं से हटाने की सोची-समझी चाल है। मातृभूमि से प्रेम का आधार नारे नहीं, बल्कि चरित्र और बलिदान हैं, जिनका उज्ज्वल उदाहरण मुसलमानों और जमीयत उलमा-ए-हिंद का अभूतपूर्व संघर्ष है। इस प्रकार के फ़ैसले देश की शांति, एकता और ��ोकतांत्रिक मूल्यों को कमज़ोर करने के साथ-साथ संविधान का भी उल्लंघन हैं।

याद रखिए! मुसलमान केवल एक अल्लाह की इबादत करता है। हम सब कुछ बर्दाश्त कर सकते हैं, मगर अल्लाह के साथ किसी को शरीक करना कभी स्वीकार नहीं कर सकते। इसलिए वंदे मातरम् को अनिवार्य कर देना संविधान की आत्मा, धार्मिक स्वतंत्रता और लोकतांत्रिक मूल्यों पर खुला हमला है।
