Over the past week, as the visibility of some of our work on social media has increased, there has been a sharp escalation in ad hominem attacks. Under normal circumstances these are best ignored, as we have an extremely strong community of Indians who fund and support our work and take a stand online based on the merits of argument and reason. However, a high volume of aspersions and coordinated attacks, alleging a "lobby", "vested interests", "big tech proxies" and the like, is emerging. This may lead to gradual suspicion of our work, which is critical for the digital rights of every Indian.
IFF has a clear mission and is funded by ordinary Indians. We are far from perfect. We also have capacity issues given the breadth and pace of digitalisation and our mandate to serve civil liberties and social justice under the Constitution of India. However, most of the targeting across social media emerges from false assertions of securitisation and betrayal of the national interest. This is false, as IFF's mandate is to serve the digital rights of every ordinary Indian and to act as a watchdog for them. This includes challenging, and advocating for reforms from, the Government of India (and state instrumentalities across the political spectrum) and technology companies. Our work over nine years, carried out by dozens of staff and hundreds of volunteers and collaborators, attests to this.
IFF's work also goes beyond the more research-oriented approaches to digital rights in order to reach the public. Here, popular advocacy, especially that which relies on social media, will lead to differences of opinion, which we encourage. However, it has taken the form of attacks. In the past, due to the targeting of several Indian organisational donors (which we ourselves had proactively disclosed) and philanthropies, our funding ceased. To overcome this, we launched a fundraiser (the Annual Membership Drive) three months ago, in which thousands of Indians chipped in to help us reach financial stability until November.
We do not have any grants or philanthropies supporting us any longer. We have a small budget and a small staff who work for the cause, funded by more than 3,000 Indians year on year, who have supported us since 2018. We will not stop fighting the good fight, and there is ample evidence that the IFF community and donors stand up for it. IFF Statement: PIB’s "Fact Check" Denies Reality. Reuters Report and Public availability of "Indian Telecom Security Assurance Requirements" Tell a Different Story
New Delhi, January 13, 2026 — The Internet Freedom Foundation (IFF) notes with concern the recent "Fact Check" issued by the Press Information Bureau (PIB), which labels the Reuters report on mandatory source code disclosure and smartphone security measures as "FAKE."
The PIB asserts that the Government of India has "NOT proposed any measure" to force manufacturers to share source code and that consultations are merely "routine." However, this denial stands in stark contrast to the existence of detailed technical documents available on a government website, specifically the "Indian Telecom Security Assurance Requirements" (ITSAR).
A simple denial via social media cannot erase the existence of policy drafts that are already in the public domain or under active discussion. If the government claims these proposals do not exist, it must explain the specific documentation currently hosted on its own website and also disclose the minutes of meetings as reported by Reuters.
In light of the PIB’s denial, IFF poses the following six specific questions to the Ministry of Electronics and Information Technology (MeitY) and the Department of Telecommunications (DoT):
1. Existence of ITSAR: Does the document titled "Indian Telecom Security Assurance Requirements" (ITSAR) exist as a government policy draft or technical standard?
2. Status of Public Documents: Is the version of the "Indian Telecom Security Assurance Requirements" (ITSAR) currently available on government websites (such as the NCCS or TEC portals) the current or operative draft under consideration?
3. Enforcement of Specific Provisions: If the answer to the above is yes, does the government intend to enforce the specific provisions listed within it, namely, the requirements for sharing source code for vulnerability analysis, retaining system logs for 12 months, and mechanisms for preventing jailbreaking?
4. Jurisdiction and Mandate: Has the Ministry of Electronics and Information Technology (MeitY) been formally tasked with the finalization and enforcement of these "Indian Telecom Security Assurance Requirements," moving the mandate beyond the Department of Telecommunications?
5. Confirmation of Meetings: Have specific meetings been held between the IT Hardware Products Wing (or Division) within MeitY and smartphone manufacturers (including Apple, Samsung, and others) where these specific clauses (source code, logs, and updates) were discussed?
6. Absence of Public Consultation: Why has no public consultation been held to date on the "Indian Telecom Security Assurance Requirements," given its massive impact on the privacy of hundreds of million Indian smartphone users? If the framework is still being "devised" as claimed, will a full public consultation be conducted before any standards are enforced?
IFF asserts that "stakeholder consultation" cannot be limited to closed-door meetings with big tech giants. If the PIB’s claim that "no final regulations have been framed" is true, then the government should have no hesitation in releasing the current draft of the ITSAR for public scrutiny immediately. We reassert the need for transparency and an open public consultation.

The Internet Freedom Foundation (IFF) is alarmed by proposals for the notification of the "Indian Telecom Security Assurance Requirements" (ITSARs) revealed in a series of Reuters reports dated January 11 and January 12, 2026. These proposals, while publicly available have not been put to public consultation by the Department of Telecommuncations and as per the Reuters reports are being considered by the Ministry of Electronics and Information Technology to be made mandatory through notification. The ITSAR includes mandatory source code disclosure, 12-month log retention, and government pre-approval for updates at the level of the operating systems in smartphones treat every citizen as a suspect and every device as a surveillance endpoint. IFF strongly rejects any proposed regime that effectively grants the State access to confidential source code and embeds persistent controls into devices used daily by hundreds of millions of Indians.
There is no clear statutory basis for these proposals, nor any evidence of meaningful public consultation and the entire exercise for their creation is being done as a bilateral discussion between the Union Government and smartphone manufacturers. From a constitutional perspective, the Supreme Court of India’s ruling in Justice K.S. Puttaswamy v. Union of India affirms that informational privacy is a fundamental right and that any State intrusion must satisfy tests of legality, necessity, and proportionality.
The requirement for manufacturers to provide "proprietary source code for review by government-designated labs" is technically unsound and dangerous. Centralizing the source code of the world's most popular operating systems to be held by the government creates a "honeypot" for state and non-state cyber attackers. If compromised, the security of every Android and iOS device in the country could be broken. Further, a 12-month record of "login attempts" and "app installations" creates a high-resolution map of a user's private life, associations, and interests. This violates the purpose limitation principle of data protection. The requirement to "notify a government organisation before releasing any major updates or security patches" is perhaps the is a counter-productive measure. Security patches are time sensitive and requiring government pre-approval introduces a bureaucratic delay during which users remain vulnerable to active exploits.
Collectively, the proposals seek to micromanage how users interact with their own devices, effectively eroding the concept of ownership. This is reminiscent of a, “nanny state” where, for instance, the mandate for "tamper detection" warnings against "rooting" or "jailbreaking" and "anti rollback protection" criminalizes advanced users who wish to customize their devices or extend the life of older hardware. This directly contradicts a users "Right to Repair" and modify the smartphones owned by them. We request for the Union Government to engage in transparent, open consultations with civil society and technical experts, not just behind the scenes lobbying with tech giants on ISTARs and halt any movement towards their notification. IFF will be writing to the Union Goverment, specifically the DoT and MEITY seeking greater transparency.
