A bench of Justice Ram Manohar Narayan Mishra of the Allahabad HC this week delivered a landmark ruling.

So the case was -  the accused Pawan & Akash saw a lonely 11yr old girl walking on the road, grabbed her breasts. Akash broke the string of her pyjama and then they happily tried to drag her beneath a culvert.

Fortunately some passerby observed this incident and interfered followed by Pawan and Akash fled from the scene.

However, Hon'ble Justice Ram Manohar Narayan Mishra found Grabbing a girl’s breasts, breaking her pyjama strings, and trying to drag her beneath the culvert is not enough to charge a perpetrator with the offence of rape, or an attempt to rape.

Throgh his ordee in prolific legal language was elaborated -
 “The allegations levelled against the accused Pawan and Akash and facts of the case hardly constitute an offence of attempt to rape in the case. In order to bring out a charge of attempt to rape the prosecution must establish that it had gone beyond the stage of preparation. The difference between preparation and actual attempt to commit an offence consists chiefly in the greater degree of determination.”

Subsequently altered the charges against two accused.
Before summoned to face trial under Section 376 IPC (Rape) and Section 18 of the POCSO Act.

Now the court has directed that the accused be tried under the minor charge of Section 354-B IPC (assault or use of criminal force with intent to disrobe).

We need more such Hon'ble Judges. 🔥

These 'unidentified men' were accompanied by ANI reporter when they went to deface the signboard of 'Akbar road' late in the night. Isn't that strange?
They are the same characters who regularly feature in many such staged/scripted videos in far-right Hindi vox pop youtube channels at Delhi’s Palika Bazar. Almost all their videos are about targetting Minority, Targetting Opposition leaders, Praising BJP govt. Ramesh Singh raped a 5-year-old girl in Shajapur district's Mubarikpur village back in 2003. He was convicted and sentenced to 10 years in prison, Was released in 2013.

In 2014, he kidnapped and raped an 8-year-old girl. This time, the lower court sentenced him to death. In 2019, the High Court overturned the verdict on technical grounds amd he was released.

In February 2025, He kidnapped and raped a 11-year-old deaf and mute girl, she was found in the bushes, her body bearing brutal injuries. A medical examination confirmed the assault.
Following his escape, police tracked him to Prayagraj, where he had gone for a Maha Kumbh bath. He was finally caught on a train to Jaipur.
