Mr. Morris Monye’s question is, with respect, a perfect illustration of why lawyers should not be engaging in legal arguments with non-lawyers. It is also why non-lawyers should avoid arguing points of law with lawyers. Law, especially procedural law, is not always intuitive; it is layered, technical, and structured. You cannot learn it by watching American movies or SUIT.

Now, to the substance.

Know that the Supreme Court is an appellate court. Its primary role is not to conduct trials or take evidence, but to review decisions of lower courts to determine whether they are legally sound. Trial courts ( like High Court or Federal High Court) are the courts of first instance. They are the ones constitutionally empowered to hear evidence, evaluate facts, and deliver judgment based on their findings.

This is how it works:

1. A matter begins at the trial court (e.g., Federal High Court). Upon final conclusion, we move to the next stage;

2. A dissatisfied party may appeal to the Court of Appeal.

3. A further dissatisfied party may approach the Supreme Court for a final review.

So what the Supreme Court does is to review. SC does not ordinarily originate or settle disputes, except in limited cases where it exercises original jurisdiction under Section 232 of the 1999 Constitution as amended.

In the instant case, the substantive dispute as to the legitimate leadership of the ADC was still pending before the Federal High Court. That is the court properly seized of the matter.

When Nafiu Bala approached the Federal High Court claiming he should become Acting National Chairman and alleged that his purported resignation letter was forged. He sought ex parte reliefs, but the court, in its wisdom, refused to grant them immediately and instead ordered that the affected parties (including David Mark) be put on notice.

Rather than respond to the substantive suit, counsel for the respondents appealed that interlocutory decision to the court of Appeal. Court of Appeal dismissed the appeal and, more importantly, granted a preservatory “status quo” order. At that point, the matter had still not been heard on its merits at the trial court.

When the case got to the Supreme Court, SC rightly observed that the appeal itself was incompetent because the appellants failed to obtain the required leave. Once an appeal is incompetent, everything built on it collapses. So the SC has no other choice than to order parties to go back to the Federal High Court where the main suit was pending.

So, the Supreme Court did not “refer” the case back in the sense of delegation. It simply did the needful by striking out an incompetent appeal and directing parties back to the only court that could validly determine the dispute.

Supreme Court cannot settle all disputes because it is the highest court in the land. The law requires that the right court handles the right issue at the right stage. It’s Federal High Court that will let us know ADC legitimate leadership. Till then, we anticipate!

The generation before ours confronted colonial domination, organized resistance, negotiated power, and secured independence under hostile conditions. Nigeria did not merely free itself, it became a force that helped others do the same.

We earned our status as the Giant of Africa through sacrifice, discipline, and vision. Thousands bleed for that title. People left their families behind for that title.

That legacy was not built in comfort. It survived a civil war, political instability, and military rule. Yet even amid turmoil, that generation protected something vital: national dignity. They understood that PERCEPTION matters and that how a nation sees itself shapes how the world treats it. Nigeria stood tall not because it was perfect, but because it believed in its own worth. They went abroad and preserved their tongue. The Queen rolled out a red carpet for Nigeria when countries like South Africa were dealing with white masters. We led an entire race and we were rightfully called the GIANT of AFRICA.

Today, that inheritance is being destroyed by the children they left behind.

A wide-eyed generation that is more interested in burning the house while they are in it than repairing it. They sell Public self-belittlement sold as activism. A politician can literally go ahead to belittle his Nation publicly and he still has followers. National embarrassment is rebranded as honesty. In the name of “speaking truth,” many fail to grasp that nations, like individuals, can talk themselves into irrelevance. They fail to introspect to know how they have degraded their own worth with their mouth so bad that a country like Namibia has the audacity to talk back at Nigeria. Namibia!!!! Our fathers fought for Namibian independence from German slavers. Their children are now objects of insults because of hate!

Criticism is necessary. But there is a clear difference between constructive critique and performative self-contempt. When a people constantly mock themselves, amplify only their failures, and strip their story of context or responsibility, the world listens and believes them. We did it during the Anthony Joshua , we do it when we tell our Japa stories, we still do. The world listens and they act accordingly. They strip you of dignity when you apply for visas and treat you like criminals when you appear at their airports. They HEARD you!

Like it or not, perception rules the world.

What makes this generation worse is the entitlement that often accompanies their self-hate. There is little appetite for sacrifice, yet endless expectation of reward. They refuse to pay taxes, they would rather a beach stands than to construct a regional road. They want to go to FREE schools, hospitals and cheapest food without giving anything in return. Then they compare their standards with others who part with their personal earnings for collective good. Little patience for institution-building, yet constant demands for outcomes. It is a vicious cycle of entitlement.

This is not rebellion. It is foolishness!

Self-respect is not propaganda. it is the foundation of collective confidence. A people that constantly denigrates itself eventually internalizes the message.

Freedom fighting was never about tearing down identity. It was about confronting injustice while preserving dignity. The generations before understood this balance and carried themselves as such. They knew that to demand respect globally, a nation must first respect itself.

Nigeria has deep problems. But nations are not fixed stories; they are ongoing projects.

This generation of Nigerians have two options. Build without tearing down or tear down and become the scum of the earth. They have chosen the latter!

A 13yrs old girl born and brought in the northern part of kaduna came to Lagos a virgin , a 46yrs old pedophile saw the innocent girl and started grooming her and seeing she had no parental guidance, not only R A P E her but also aborted for the girl in the space of two years. All was broke loose when during the 3rd pregnancy he bought a pill for her to take and after taking it the now 15yrs old girl was bleeding for days and sensing her life was in danger she went to the general hospital and it was there she revealed what the pedophile has been doing to her for years and I was called in, this man groomed her in so many ways unimaginable,he was arrested and charged to court and later sent to prison pending when the final verdict is due. Some of this residents of the building tried to victim blame the girl but I stood by her and called it off, I will be going for the 3rd appearance of the pedophile next month and would be there to see him get his full sentencing.

When mourning with people, there are lines that intelligently decent human beings do not cross. Empathy has borders. Wisdom enforces them.

When a person has just lost a fortune to a business misadventure, it is never the appropriate moment to remind them that they once declined to lend you money before investing in that same venture.

When a person has just lost a child, it is never the right time to announce that your own child has just secured admission.

When someone has narrowly survived a fatal accident, it is never the sensible moment to lecture them about why they should not have travelled ot that location, or why the timing was wrong.

When a woman has just suffered a miscarriage of a pregnancy she long prayed for, that is never the moment to inform her that you and your husband are now planning twins as your fifth and final delivery.

Decency is knowing when silence is the highest form of speech.

A countryman of ours - still grieving, still raw, still broken - is burying his friends today. And your bitter, unfortunate soul thought it was the perfect moment to remind him that “Nigeria happened to him.”

That is honestly cruelty embedded in evil.

Women, by nature, are drawn to joy, peace, and emotional safety - none of which it appears you are capable of providing. And that explains everything. Nothing more needs to be said.
