75-Year-Old Man Spends 9 Months in Jail After Being Falsely Accused in POCSO Case, Acquitted by Alappuzha Court

▪The Alappuzha POCSO court acquitted a 75-year-old man who spent 9 months in jail in a false POCSO case.

▪In November 2022, Joseph, a 75-year-old man from Alappuzha, Kerala, who was working as a school security guard, was accused by a minor schoolgirl of sexually assaulting her. Based on her complaint, he was arrested and remanded to custody.

▪“It was a real shock for me, as I knew the girl and her family very well. They came from a poor background. Even now, I pray to God for the girl, who is even younger than my grandchildren,” Joseph said.

▪While Joseph remained in jail, it later emerged that the actual culprit was a young man, and the girl had falsely implicated Joseph to protect the real offender.

▪During the trial, the girl broke down and admitted that she had made a false allegation. She apologised to Joseph, explaining that she had been compelled by the real culprit to give a false statement.

▪Joseph said, “The girl cried a lot and apologised to me after correcting her statement during the trial. She might have given the false statement under the compulsion of the real culprit. I am happy that my family, as well as close friends and relatives, stood by me.”

▪After the girl retracted her statement, the court granted bail to Joseph in July 2023. Despite the humiliation and nine months of imprisonment, Joseph decided not to take any legal action against the girl.

▪Finally, on 29 July 2025, the Alappuzha POCSO court acquitted Joseph of all charges.

▪His lawyer, Adv. P. P. Baiju, emphasised that such cases are not isolated incidents and called for caution in handling sensitive allegations under POCSO.

Respectfully disagree with the Bombay High Court judgement both on rationale and result; that requires a longer exposition elsewhere. But is the High Court so insensitive to freedom that it believes it requires 4 days to decide a simple bail matter in a case of abetting suicide??
