Last night, Bill C-9 passed third reading in the @SenateCA during its review of the bill, the Senate Human Rights Committee heard extensive testimony and proposed several amendments. These included creating a new criminal offence for residential school denialism, and restoring the former "good-faith religious text" defence that Bill C-9 would repeal.
All of the above amendments were rejected. Bill C-9 passed third reading with only one amendment, the addition of the noose to the list of prohibited hate symbols.
What happens next?
The bill will now return to the House of Commons for consideration of the Senate amendment. If the government accepts the amendment, the bill will proceed to Royal Assent and become law.
Our concerns with the bill remain the same. Despite pushback from faith leaders, civil liberties organizations, and legal experts, the senate proceeded to pass bill C-9. The bill continues to retain the Bloc Québécois’ amendment removing the “good-faith” religious-text defence from the criminal code, with an additional insufficient circular clause added by the Liberals.
The bill in its current form continues to raise several significant concerns, including the absence of certain prosecutorial safeguards, the introduction of vague and overly broad offences related to “intimidation” and “obstruction,” and an expanded scope that extends beyond places of worship. The legislation creates significant legal uncertainty and opens the door to arbitrary and discriminatory enforcement and a chilling effect on dissent. The bill also broadens the hate propaganda provisions to include the display of symbols tied to the discretionary and politicized terrorist entities lists.
CMPAC and the broader Canadian Muslim community unequivocally support the protection and sanctity of places of worship and all efforts to address rising hate in this country. We urge parliamentarians to reconsider this legislation and pursue measures that effectively address hate while safeguarding fundamental freedoms and maintaining public confidence in Canada's legal framework.
