🚨 JUST IN: BURIED IN A 7-PAGE SEC LETTER: THE 20% RULE THAT COULD MAKE $XRP “BALANCE-SHEET READY”

Most people think institutional adoption begins and ends with legal classification.

It doesn’t.

Classification tells a regulated firm what an asset is.

Capital rules determine how that asset affects the firm’s balance sheet when it holds a proprietary position.

THE HIDDEN RULE

That second question is buried inside Ripple’s May 22 letter to the SEC Crypto Task Force.

Under the SEC staff’s current FAQ, broker-dealers may treat proprietary positions in Bitcoin or Ether as “readily marketable” when determining whether the 20% commodity haircut under Rule 15c3-1 applies.

A “haircut” does not reduce XRP’s market price.

It is a regulatory risk deduction used when calculating a broker-dealer’s net capital.

The current FAQ expressly names BTC and ETH.

#Ripple wants the framework widened beyond them.

RIPPLE’S PROPOSAL

Ripple proposed that a digital commodity could be treated as “readily marketable” when at least one of these market-quality tests exists:

① An ETP is listed on a national securities exchange.

② The asset is quoted on an interdealer quotation system such as Nasdaq.

③ Multiple dealers provide bona fide, competitive bids and offers.

THE $XRP CONNECTION

The SEC’s April 2026 crypto resource lists XRP among its examples of digital commodities.

Ripple’s letter says it asked whether the existing treatment extended beyond BTC and ETH.

According to Ripple’s account of that meeting, the Crypto Task Force said it did not want to appear to pick “winners or losers” by referencing XRP or other assets.

Ripple’s answer was an asset-neutral test.

THE THREE INSTITUTIONAL GATES

Institutional adoption has three separate gates:

GATE 1 — CLASSIFICATION

What is the asset under the regulatory framework?

GATE 2 — CAPITAL TREATMENT

How does holding it affect a regulated firm’s available capital?

GATE 3 — MARKET PLUMBING

Can dealers hold inventory, facilitate ETP creations and redemptions, and make markets under predictable rules?

Legal classification opens the door.

Balance-sheet treatment can determine whether regulated firms walk through it.

THE IMPORTANT LIMIT

This proposal would not require any broker-dealer to hold XRP.

It would not guarantee demand, adoption or price appreciation.

And it is not current SEC policy.

But if the SEC adopted Ripple’s proposed approach, qualifying digital commodities could gain a clearer path into regulated dealer inventory and market-making.

That could become one of the least discussed—but most important—layers of institutional infrastructure surrounding $XRP.
