ATM AZHARUL ISLAM

THE JHARUARBEEL MASSACRE | 1,200 CIVILIANS REPORTED KILLED | OVER 200 HINDUS ALLEGEDLY ABDUCTED AND MURDERED | DEATH SENTENCE OVERTURNED

On 17 April 1971, Pakistani soldiers and their local collaborators carried out a massacre at Jharuarbeel in Rangpur, then East Pakistan.

According to the prosecution case examined by Bangladesh's International Crimes Tribunal, approximately 1,200 unarmed civilians were killed in the attack.

The prosecution also alleged that more than 200 Hindus and students were captured, taken to an unknown location and murdered.

Among those accused of helping organise the atrocities was ATM Azharul Islam, then president of the Rangpur unit of Islami Chhatra Sangha, the student wing of Jamaat-e-Islami.

THE JHARUARBEEL MASSACRE: 17 APRIL 1971

Pakistani soldiers and armed collaborators surrounded Jharuarbeel and opened fire on civilians.

The prosecution described indiscriminate shootings of men, women, children and students.

Houses were looted and burned.

The tribunal's original judgment accepted evidence implicating Azharul Islam in the massacre.

It convicted him of crimes against humanity and genocide in connection with the events.

THE MURDER OF HINDU PROFESSORS

Another charge concerned the abduction and killing of four teachers associated with Rangpur's Carmichael College:

Professor Chitta Ranjan Roy, Professor Sunil Baron Chakraborty, Professor Ram Krishna Adhikary and Professor Kalachand Roy.

Monju Sree Roy, wife of Professor Kalachand Roy, was also named among the victims.

These murders formed part of the allegations examined during Azharul Islam's prosecution.

THE ORIGINAL VERDICT

On 30 December 2014, Bangladesh's International Crimes Tribunal sentenced ATM Azharul Islam to death.

On 31 October 2019, the Supreme Court upheld his death sentence.

For several years, he remained imprisoned under that conviction.

THE SUPREME COURT REVERSAL: 27 MAY 2025

In a major legal reversal, a seven judge bench of Bangladesh's Supreme Court overturned the earlier conviction and death sentence.

ATM Azharul Islam was acquitted of all charges. He was released from custody on 28 May 2025.

In its subsequently published judgment, the Supreme Court acknowledged that its earlier decision had failed to give adequate consideration to deficiencies in the evidence and the requirements of a fair criminal trial.

The acquittal means that Azharul Islam cannot accurately be described as a convicted war criminal.

The earlier tribunal findings and the prosecution's allegations remain part of the historical court record, but they no longer establish his criminal guilt.
