On Friday, September 25, 2026, the Supreme Court stayed a lower-court injunction and allowed the Trump administration to keep using the modified SAVE system for citizenship checks.

The system, run by DHS, was expanded after a March 2025 executive order. The changes added Social Security Administration records (including SSNs) and enabled bulk searches so states and localities could check multiple records at once instead of one-by-one.

Foreign-born ( born in San Fernando, Trinidad and Tobago) Biden DOJ attorney (Civil Rights Division) and now U.S. District Judge Sparkle L. Sooknanan in D.C. blocked the expanded version in June 2026, finding it violated privacy and Social Security Act limits on disclosure.

The D.C. Circuit left her order in place. SCOTUS lifted that stay. The unsigned majority opinion said the injunction “inhibits the Federal Government’s efforts to assist state and local agencies in the proper administration of the midterm elections.” Justices Jackson, Sotomayor, and Kagan dissented.

On timing and the midterms: the National Voter Registration Act generally bars systematic, large-scale voter-roll purges within 90 days of a federal election. November 3 is inside that window, so mass removals based on bulk SAVE matches are constrained. The Court noted states can still do individualized inquiries. The administration has said the system already processed tens of millions of records in 26 states before the June pause and flagged tens of thousands as potential noncitizens; critics point to documented false flags, especially of recently naturalized citizens whose SSA records lag.

The claim that DHS/DOJ work began well before the June injunction is consistent with the timeline: the executive order was March 2025, the modified SAVE launched later that year, and states were already running rolls through it in 2025–early 2026.

The June order paused the expanded features.

Whether that window is “enough” to change 2026 outcomes is a practical question about how many states use it, how they handle flags, and how quickly they can complete individual follow-up—not a legal bar on the tool itself.
