Regarding FTX’s so-called “Restricted Jurisdictions” procedures, I’ve spoken with many lawyers and so-called advocates for justice. Frankly, most are soft and just want to follow the process, follow the judge, rather than discuss the actual facts. They all think that if the motion was filed by the FTX Recovery Trust, it won’t be rejected and should move forward. They say I’m too aggressive.
But what are the facts? When calculating claims, they said it’s in USD — BTC was valued at $16,500. But when they want to withhold creditors’ funds, suddenly there’s “crypto regulation,” and it’s not USD anymore. During distributions, again they say it’s not USD, because of crypto regulations.
I asked lawyers about this; they agreed with me. I asked the judge if this is counted in USD — there was no answer.
I’m not being aggressive. I’m simply stating the plain facts. I’m not a lawyer, but even my basic understanding of law tells me: the law must be based on facts. Only with facts can we talk about the law. If the facts aren’t clear, what’s the point of talking about procedures or legalities?
