“This is nowhere near the right to protest.” — Harish Salve
Those still defending the violence at Jantar Mantar should listen carefully to one of India’s foremost jurists.
Harish Salve draws a clear constitutional distinction between peaceful protest and unlawful violence. Holding placards, making speeches, seeking permission to march, or even courting arrest as a symbolic act are all protected democratic rights.
But attacking police personnel, breaking barricades, surrounding officers, and inflicting injuries are not.
As Salve points out, public order is a constitutional limit on the right to protest. Article 19 protects peaceful dissent, not lawlessness.
Those attempting to justify or whitewash what happened at Jantar Mantar are not defending democracy. They are defending the indefensible.
