Aquí tenéis el decreto 3160/1966 (Estatuto Jurídico del Personal Médico de la SS). Exclusivamente médico, que regulaba específicamente el acto médico. Tenía mecanismos de negociación propios y reconocía la especificidad profesional del médico. Ese reconocimiento se perdió en 2003, cuando un Gobierno del PP aprobó la Ley 55/2003, del Estatuto Marco del personal estatutario de los servicios de Salud. Dicha ley borró la especificidad médica y unificó normativamente a todo el personal sanitario, diluyendo nuestras particularidades en un modelo homogéneo.
Lo teníamos. Lo perdimos. Y fue una decisión política, no técnica.
Desde entonces, por pura aritmética (los médicos somos solo el 15 %- 20 % de la plantilla), otros colectivos han pasado a decidir sobre nuestras guardias, descansos, condiciones y hasta nuestra carrera, sin que tengamos un peso real en la mesa de negociación. Así llevamos más de 20 años.
Tenemos que recuperar el espíritu del Decreto 3160/1966, adaptándolo al presente: un marco legal que reconozca de forma explícita la especificidad del acto médico y la singularidad de nuestra responsabilidad profesional.
