Here’s how it works: The Constitution vests courts with the power to interpret the law, with room for appeal, and the Supreme Court’s interpretation holds final sway.
Then, if Congress disagrees with the courts’ interpretation of a law, it can pass a new law clarifying the language in response to the courts’ decisions.
The President can cajole Congress to do this, but he cannot do it himself. He can only execute the laws that Congress passes as interpreted by the courts once the issue has been finally decided.
That’s the separation of powers—and it has worked like a charm for nearly 250 years of our history. The tyranny is not in the courts, it’s in the White House. Quit waging war on our constitutional order.
