On February 9, We Ask for the Restoration of Students Unions, Which had faced a Ban for over four Decades

In the history of Pakistan the February 9 is known as the “Day of Infamy” as on this day in 1984 the students unions were banned throughout Pakistan. During the Zia ul Haq’s martial regime the ban was imposed through the MLOs (Martial Law Orders) No. 1371 and 227. As the Amnesty International states that “the ban was justified under Zia’s Martial Law as a measure to suppress student activism, under the pretext of curbing on-campus violence.”

It is believed that the ban was repealed in 1989, when a democratic government assumed power, however, no concrete action has been made to resolve the ban. In a case between ���M Islamil Qureshi vs. M Awais Qasim”— Secretary General of Islami Jamiat Tulba— the supreme court ruled in and legalised the ban by making it necessary for the students to sign an affidavit and solemnly declare that they will not indulge in student activism. This was the result that the students were deprived of their freedom of expression, assembly and association.

We assume that the denial of students rights is a violation of fundamental human rights and is inconsistent with the principles of natural justice. It has been 42 years since the student unions have been facing a complete ban and academic suppression. The students have been denied access to the rights of expression, peaceful assembly and association which are protected by international human rights law including the Constitution of Pakistan.

It is our very fundamental right to express our views to hold peaceful assembly and to associate ourselves with student activism in accordance with the law. However, the refusal leaves the students in a discombobulated state where they are deprived of their activism which, we believe, is an innocuous activity. When students are granted access to the student activism, indubitably, new ideas will emerge and they will be able to lead the nation towards enlightenment and well-being.

We, on this day, ask the government in power to review the four decades old decision and lift the ban promptly, as we, reaffirm our commitment to the activism that through suppression, we organise and our voices are unbroken. We Remember, Resist and Reclaim.
