Lest we forget, Justice Esther Kisakye's troubles started when she defied Mr. Owiny-Dollo and made an independent ruling in the Hon. Kyagulanyi @HEBobiwine versus Gen. Museveni election petition. Seems the Chief (in)justice wanted the two rulings dismissing the applications to be unanimous.

In the two applications, we asked the Supreme Court to;

1. Allow us amend our petition and introduce more grounds. Most significantly we wanted a pronouncement on an amendment to the Presidential Elections Act which bars from running for President, any person holding or acting in an office connected with the conduct of an election. We argued that Gen. Museveni was significantly involved in the conduct of that election and this provision applied to him.

2. Allow us file additional evidence in the form of affidavits and the corresponding videos, DR forms, etc.

We argued that there were special circumstances warranting the grant of these prayers. These circumstances were; (i) Hon. Kyagulanyi was kept under house arrest for 10 out of the 15 days he had to file his petition, in which period he would not freely interact with his legal team or even be able to gather sufficient evidence in time. (ii) Several of his potential witnesses had been abducted and were still in detention, including polling agents who were bringing DR forms. (iii) His legal team had to work from mobile law firms for fear that state operatives would attack and take away whatever evidence was left. (iv) The Party offices where some of the evidence was kept, was under siege by the police and military and no one was allowed to enter.

In her ruling delivered in a dark tent, using a duplicate copy of her ruling after the original one was confiscated by Mr. Dollo (as she said), Justice Kisakye reasoned that by detaining Hon. Kyagulanyi at his home for 10 days which was confirmed by the High Court, the state prevented him from preparing his petition and therefore it was proper for him to amend his petition and introduce more grounds, and to be allowed to file more evidence out of time.

For doing this, she has had to pay such a great price. Justice Esther Kisakye is no ordinary citizen, but a judge of the highest court in the land! If they can do this to her, you can imagine what fear and victimisation follows other Ugandans in lower echelons of society!
