Perehdymme KKO:n 13.4. antamiin päätöksiin koskien saamelaisten kalastusoikeuksia.

6/6. Even if the English summaries focus on the Finnish Constitution, #ICCPR article 27 had a prominent place in the judgments. Conratulations @korkein_oikeus @MFredman@ANuorgam and others!
5/x. It unusual that the Supreme Court of Finland poblishes English summaries of their rulings. Here's the second one. One should also note that the judgments were published in full both in Finnish and Northern Sámi (as required by the Sámi Language Act) https://t.co/TljHcvVo7H
4/x. The second case KKO 2022:25 was about fishing out of season. As the fishing season was defined in a governmental Decree (and not an Act of Parliament), it was easy for the Supreme Court to apply Section 107 of the Constitution to declare that the Decree was "without effect"
3/x. This alone is big news, as the power of courts under Section 106 of the Constitution, not to apply an Act of Parliament if that resulted in a manifest/evident conflict with the Constitution, is very rarely resorted to by Finnish courts which tend to be quite deferential
2/x. In KKO 2022:26 the Supreme Court concluded that the application of an Act of Parliament would manifestly breach the right of the Sámi to enjoy their own culture (ICCPR art. 27 and Section 17.3 of the Finnish Constitution), and had to be set aside https://t.co/3SDj6PdISe
Important victories for the indigenous Sámi people in the Supreme Court of Finland. In both cases it rejected criminal charges against Sámi individuals who engaged in fishing and taught the next generation to fish, in contravention of strict regulations imposed by the state. 1/x
