EB-1A Approved for a Distinguished AI

YES!!!!

EB-1A approved without a substantive RFE on the merits for a distinguished AI researcher and engineer working on one of the frontier models.

This was a very strong case.

The client had thousands of citations to his research and publications, including work published on arXiv, and we argued:

✅ Publications
✅ Leading and critical role
✅ Original significant contributions
✅ High compensation

What was interesting: USCIS did not issue an RFE challenging the merits of the case.

Instead, they issued an RFE requesting that the client complete biometrics to prove his identity.

As soon as I saw this, I had a strong feeling that the case had already been approved on the merits. But of course, it was still nerve-wracking for the client because USCIS did not clearly explain what was happening.

The case was subsequently approved.

I have now heard of similar situations from others, and I recently had a consultation with an individual who received a similar biometrics request in connection with an I-140.

I wonder if this is becoming the new normal: biometrics on certain I-140s before approval is issued.

Either way, we are thrilled for the client.

AI researchers and engineers are doing some of the most important work in the world right now. When someone is operating at this level—building, publishing, contributing, and leading in a field that is moving this quickly—the EB-1A can be the right vehicle.
