What's the EU pov on US AI policy? Fewer better people to ask than @MarietjeSchaake
Thanks to Marietje for joining @Klonick & me on @scaling_laws
On Lawfare Daily, @Klonick interviewed @RonanFarrow and @andrewmarantz about their recent @NewYorker article on Sam Altman, the products he's building at OpenAI, and how he's selling them not just to investors and the public, but also to regulators and world leaders.
Can't imagine a better place and a better person to make this pitch for ending cookie banners with than @verge with @pierce
Honored to have my latest law review article featured! Have a listen!
What does it look like when the government violates court orders in 300 separate immigration habeas cases?
Katherine Pompilio and Benjamin Wittes announce a new database which tracks government non-compliance with court orders around the country.
Cookie banners were supposed to protect your privacy. Instead they've made consent meaningless, wrecked UX, and blocked better regulation. @klonick makes the case: BAN THEM! #Privacy#CookieBanners#TechPolicy https://t.co/sZ8avAtaK9
Published my latest article BAN COOKIE BANNERS: A CASE STUDY IN TECH REGULATION in the Harv. J. of Law & Tech!
A cri de cœur to end this worse-than-useless regulatory compliance regime and let something that actually protects users take its place.

Its the "Chicken Sh*t Bingo" Edition!
On this week's Rational Security, @S_R_Anders, @AnnaBower, @KevinTFrazier, and @Klonick talked through the week’s big national security news in tech, including Anthropic's lawsuit challenging its supply chain designation, the Artemis II mission, and more.
My latest for Lawfare on how Marco Rubio's open instruction to use X for U.S. propaganda and diplomacy is the latest high water mark in government cooptation of private platforms.

A person familiar with the situation tells me that Pam Bondi will be out as AG imminently, confirming scoops from @CNN and @nytimes.
When Trump met EPA boss Lee Zeldin on Tuesday to discuss last year’s California wildfires, Trump also discussed the potential of tapping him for the AG role, a person close to the WH tells me.
@CNN and @nytimes also both named Zeldin as the most likely successor.

I wrote about how cookie banners are not just impotent tech regulation/compliance, but make our lives & world worse in myriad ways. We should actively get rid of them.
And as we move into a critical period of AI regulation, these historic lessons are absolutely essential

Yesterday evening, Benjamin Wittes sat down with @Klonick, @mollylroberts, and @rparloff to debrief the hearing that occurred on Anthropic's request for a preliminary injunction in their challenge to the Department of Defense's designation of it as a supply chain risk.
Also, editor in chief Ben Wittes will be leading a panel discussion afterward with colleagues @mollylroberts , @Klonick, maybe @AnnaBower (depending on timing), & me.

ICYMI: Watch this week’s Trials of the Trump Administration where Benjamin Wittes sat down with @Klonick, @rparloff, @AnnaBower, @EricColumbus, and @mollylroberts to discuss the government’s response to Anthropic’s suit, a judge returning VOA employees to work, and more. https://t.co/eW2gRVoh4P
So please, spread this far article far and wide. If my legacy as a scholar was to be part of the end of cookie banners, I would die a happy legal academic.
Oh and don't forget to appreciate the irony when you click on the link to download :)

But there is hope! The European Commission is currently reviewing the laws that gave us cookie banners. We can get rid of them!
And we have the ability to not make the same mistakes in the future as we regulate AI, where _actual_ protections are more important than ever.
