Sub: 19% Default notice to buyers due to INOPERATIVE PAN of Seller and Poor policy implementation by CBDT

This is mental harassment of honest taxpayers. We tried to reach every office in Income Tax, however no one knows how to rectify this fault.

This is a classic case of poor policy implementation by CBDT.

Income Tax Systems Dept failed to update the TDS portal as per CBDT Notification No.15/2023 dated 28th March, 2023. They took more than 6 months to correct their TDS portal. Had they made these changes on 1st July 2023 itself, buyers like me would have avoided this hassle and metal trauma.

It's a matter of introspection, how any new policy is implemented. There are many loopholes in TDS portal to trap buyers. Here are few of them

1) TDS portal did not flag PAN status and by default calculated TDS @ 1%. As the department has all data, the portal should have changed TDS rate to 20% in case of inoperative PAN. Buyer pays TDS amount as calculated by TDS portal and even their was no option to change TDS amount.

2) As per CBDT Notification No.15/2023 dated 28th March, 2023 system was supposed to be equipped with new rules, however there was no enhancement made in the portal until 11 Jan 2023. While notification clearly said that there will be enhancements in portal

The Principal Director General of Income-tax (Systems) or Director General of Income-tax (Systems) shall specify the formats and standards along with the procedure for verifying the operational status of permanent account number under sub-rule (1) and sub-rule (2).

3) We got default notices after 4-5 days of TDS payment. By this time all money is already paid to the seller and registration is completed. After paying full money to the seller, we have no option to deduct 19% TDS.

I have send tons of emails to CBDT officials, strangely many of Sr officials does not understand problem and do not know how to fix this.

This mistake from Dept has impacted 1000's of honest buyer who put all of the saving to purchase home. This notice amount is in Lacs and TDS dept has sent notice to submit 19% of property value + 1.5% interest.

We have send several emails, however have not received any resolution from Dept.

प्रदीप जैन , चक्रेश, दोनों नवीन जैन के भाई है जो भारतीय जनता पार्टी के राज्यसभा सांसद हैं

नवीन जैन के 2024 के चुनावी हलफनामे के अनुसार उनकी घोषित कुल संपत्ति लगभग ₹441.95 करोड़ थी। उसी हलफनामे में उन्होंने PNC Infratech के लगभग ₹291.99 करोड़ मूल्य के शेयर और NCJ Infrastructure Pvt. Ltd. में लगभग ₹72.68 करोड़ की हिस्सेदारी घोषित की थी।

सवाल यह उठता है कि
- NHAI ने क्या प्रमाणित किया?
- contractor को भुगतान से पहले कौन-कौन से quality certificates लिए गए?

इस कंपनी को और कौन कौन से ठेके मिले है

अप्रैल 2026 में PNC NHAI के दो projects में भाग ली, जिनकी संयुक्त Bid Project Cost लगभग ₹3,483 करोड़ थी

Lucknow Development Authority का लगभग ₹200 करोड़ का Gomti river bank 4-lane flyover project

UP State Bridge Corporation का लगभग ₹559 करोड़ का EPC bridge project

Prayagraj–Kaushambi रोड का ठेका

ताजुब की बात यह है इस कंपनी को NHAI और राज्य सरकारों ने महाराष्ट्र से लेजर पुणे, यूपी में कई बड़े ठेके मिले है

2025 में कंपनी की reported order book लगभग ₹17,792 करोड़ थी

The construction quality of ₹4700 crores Lucknow-Kanpur Expressway which was inaugurated by cabinet minister Rajnath Singh, Nitin Gadkari and UP CM Yogi Adityanath was so poor that the highway was damaged at multiple places in less than a fortnight. The scale of corruption was so high that the NHAI had to "blacklist" PNC infratech, the shady construction company owned by brother of BJP MP Naveen Jain. NHAI has declared the Expressway toll free till the time the repair works are underway.

One year since this audacity.

The victim is bedridden, disoriented, and surviving solely on support, fed through a Ryles tube and requiring round-the-clock nursing and specialized care just to stay alive.. As a family of four with only one earner, they’ve exhausted their savings and borrowed heavily to cover monthly medical bills running into lakhs. They are now crowdfunding, having received no support from the accused’s family.

Meanwhile, the accused is out on bail. The case drags on with long adjournments, and according to a post in r/jammu, the High Court has interim-stayed proceedings under Section 109 (attempt to murder), though I couldn't independently verify this.

What should have been an open-and-shut case will be dragged out for years. Once public memory fades and the family loses the spirit to fight, which they already have, the accused will walk away without consequences.

A stretch of the Lucknow-Agra Expressway was built by PNC infratech. In 2018, UP Government awarded a bonus of ₹58 crores to PNC infratech, a company owned by brother of BJP Rajya Sabha MP Naveen Jain, for its early completion. Within 6 months of awarding the bonus, an SUV plunged into a 50-foot-deep ditch after a service road of the expressway caved in. Same company was awarded contact to construct to the Lucknow-Kanpur Expressway.
