The current political environment in the country is tense and strained by actions that undermine the rule of law. It is important for all well-meaning Kenyans to take deliberate steps to bring an end to the cyclic violence, institutional weaknesses, and constitutional violations that threaten the relative political stability we have had in the past decade. That stability is predicated on accountability by all institutions charged with the rule of law and justice for all victims of human rights infractions.
This period calls for responsible discharge of duties and fair application of the law. Anything to the contrary, including the recent abuse of the Prevention of Terrorism Act where the context directly contradicts the clear provisions of section 2 that the Act should not be used in matters relating to demonstrations, only threatens to aggravate the national cynicism on the objectivity of our institutions. We note that this trend has increasingly emerged on the back of the Chief Justice's remarks on the burning down of the Kikuyu Law Courts. However, while we appreciate the need for caution in statements made by national leaders, the same do not override express provisions of the law.
We call upon all justice sector players to rise to the occasion and reset the country's trajectory to one of constitutionalism, cohesion, law, and order
