FOR CLARITY: Section 301 of the Trade Act of 1974 is a U.S. trade law that authorizes the Office of the United States Trade Representative (USTR) to investigate and respond to foreign trade practices that are deemed unfair, unjustifiable, unreasonable, or discriminatory and that burden or restrict U.S. commerce.
▪️Purpose: To enforce U.S. trade rights and address foreign acts, policies, or practices that violate trade agreements or harm U.S. commercial interests.
▪️Initiation: Investigations can be triggered by a petition from a U.S. party or initiated by USTR on its own.
▪️Process: Includes public consultations, evidence gathering, hearings, and a determination within 12 months. USTR must consult with the foreign government and may seek dispute settlement under applicable trade agreements.
▪️Actions: If a violation is found, USTR may impose tariffs, withdraw trade concessions, or negotiate binding agreements to remedy the issue. Tariffs are prioritized if import restrictions are chosen.
Under Section 301(b) of the Trade Act of 1974, the USTR has the authority to self-initiate such investigations. The probe examines whether foreign acts, policies, or practices are unreasonable or discriminatory and burden or restrict U.S. commerce. ➡️Specifically United States Trade Representative (USTR) has initiated a Section 301 investigation into South Africa and 59 other countries, including major trading partners such as China, India, the European Union, Canada, Mexico, Japan, South Korea, the UK, and the UAE, to assess whether they engage in unfair trade practices.
ALSO NOTE FOR CLARITY: What specific forced labor practices is the USTR targeting in South Africa? The USTR has not specified unique forced labor practices in South Africa within the Section 301 investigation. Instead, it is assessing whether South Africa adequately prohibits and enforces bans on the importation of goods produced with forced labor, which could create an unfair trade advantage.
However, external reports highlight sectors in South Africa where forced labor has been documented:
▪️Agriculture: The U.S. Department of State’s Trafficking in Persons Report indicates that forced labor is reportedly used on some fruit and vegetable farms across the country.
▪️Fishing/Seafood: Forced labor or forced child labor has been reported in South Africa’s fishing and seafood sector.
▪️Apparel Manufacturing: In the past, workers from Mozambique, Eswatini, and Lesotho were allegedly trafficked to apparel factories in South Africa under false job promises.
The investigation focuses on South Africa’s broader enforcement of import restrictions on such goods, not just domestic production practices.
