At the ongoing Capacity Building Workshop for Anti-Corruption Institutions in Bulawayo, today’s focus is on critical pillars of accountability:
🔹 Understanding Corruption Offences under Zimbabwe’s Criminal Law Code
The session unpacks the scope and meaning of corruption offences in Chapter IX of the Criminal Code. Too often, investigators and prosecutors default to charging criminal abuse of duty as a public officer (s.174), creating a narrow and sometimes weak foundation for cases.
The discussion stresses that corruption manifests in multiple forms, each with distinct offence provisions and evidentiary requirements, including:
Bribery (s.170): the “original sin” of corruption, where inducements or rewards distort decision-making.
Corruptly using false documents (s.171): fraudulent paperwork used to deceive principals.
Concealing transactions from a principal (s.172): non-disclosure or misrepresentation even after a transaction is completed.
Concealing a personal interest (s.173): insider trading and undisclosed conflicts of interest.
Criminal abuse of duty as a public officer (s.174): deliberate misuse of office to confer undue benefit or cause prejudice.
Key point: misapplying or over-relying on s.174 weakens prosecutions.
Correctly matching charges to facts makes cases stronger, more focused, and more likely to succeed, while protecting judicial resources and public confidence.
🔹 Cyber and Digital Evidence
With corruption increasingly leaving digital footprints, this session focuses on the importance of properly handling electronic evidence to strengthen prosecutions.
Participants explore:
Collection & Preservation: retrieving data without tampering.
Authentication & Admissibility: maintaining a chain of custody so courts accept the evidence.
Digital Forensics: tracing financial flows, communications, and records across platforms.
Risks of Weak Practice: poor handling of evidence that leads to case collapse.
In today’s digital era, emails, mobile data, financial records, and metadata often hold the key to exposing corrupt conduct. Mishandling them undermines accountability. These sessions show that effective anti-corruption work requires both legal precision and technical sophistication.
Strong knowledge of offences ensures investigators and prosecutors charge correctly; mastery of digital evidence ensures those charges are backed by proof that stands in court.
