@NC_CyberLaw I agree in most cases. The year I clerked for an appellate judge, I don't think any oral argument changed the outcome. I remember one case in particular where the appellant had written a brilliant brief but her lawyer's oral argument performance was dreadful. She still won.

@nottooloud @ericbradner That's really not his job. His job is to say what the law is, not to make it more caring. If you thing a judge deciding a case should say to himself, "what is the most caring outcome," and go with that, you just don't understand the role of courts and the rule of law.

And, yes, elections can be stolen. But the way to stop them is in court and upholding the rule of law, not by mob violence and threatening government officials. (And no, the 2020 presidential election was not stolen. Trump lost.)

@EdWhelanEPPC Interesting article. My partner's wife is a US District Court judge, and she has always recused from my firm's cases. And her husband isn't a litigator. I've seen other federal judges recuse when another relative's firm was in the case (e.g. a nephew). I guess it isn't mandatory.
