I tend to agree with my brother on this to the extent that jurisdiction of a court is not based on the person of the judge but the court as an institution. Constitutionally, the qualifications for a judge of the HC and of a special court are the same thus similar competence.

The paper doesn't challenge judicial specialization. The Crux of the argument is; jurisdictional bounds should only apply to the 3 Courts as institutions and not to judges appointed to those Courts.
