I remain convinced, in the birthright citizenship case, that the children of transients (or birth tourists) case was a close one, but that the majority's decision was just obviously correct as a textual & historical matter on the children of illegal immigrants.
The dissent from Neil Gorsuch in the birthright citizenship case is actually very interesting. He basically says that he would deny birthright citizenship to children of temporary visitors but not to illegal immigrants who lived here permanently. So on the question of whether illegal immigrants' kids are citizens, it's actually more like a 7-2 decision.
I was disappointed to see Gorsuch dissent on birthright citizenship case, but it seems he's AOK with illegal immigrants' kids being US citizens. He's just not OK with birth tourists (intentional or accidental).
