Recently on Facts First, we talked about how we had to adjust our strategy during the examination of Atty. Michael Poa as a hostile witness.

As a rule, a hostile witness may be examined through leading questions, many of which are strategically designed to call for a yes-or-no answer. However, since Atty. Poa was allowed to explain his answers, and we were not allowed to play relevant video excerpts from previous legislative hearings that we had intended to use in confronting him with his prior testimony, we had to recalibrate our strategy on the spot and adjust our examination in real time.

That need to adapt applies not only to strategy, but also to courtroom style. Different situations call for different approaches. Sometimes, you have to match the energy of opposing counsel. And when you believe your position is supported by the rules, you have to stand your ground.

After all, in these proceedings, we are not fighting merely for a private client.
