At speeds that slow that isn’t even really tailgating as there is still adequate reaction and stopping time between them.

Driving irrationally slow is actually irresponsible, because it angers people and causes them to act more recklessly.

If any one of those other vehicles on the right decide to cross the double white, and do so without checking if you are coming, than they will only be in the wrong legally and morally. Plus they would be dodging the toll on top of illegally crossing the double white, on top of improper lane change.

So no. Don’t defend this behavior. People pay a lot of money to use this toll lane to go way faster than the traffic on the right. That’s the whole freaking point of that lane.
