This is an extraordinary moment, and not in a good way.
The Scottish Information Commissioner has been forced to take the Scottish Government to the Court of Session for refusing to comply with a lawful Freedom of Information ruling. Not misunderstanding it. Not appealing it. Ignoring it.
This is the first time this has ever happened.

Freedom of Information is not a suggestion. It is not a favour granted by ministers when reputational risk is low. It is a statutory obligation that exists precisely to stop power marking its own homework.
When a government misses deadline after deadline, even after formal warning of legal action, it is no longer a question of administration. It is a question of attitude.
Delay becomes defiance.

For those of us running charities, this is deeply uncomfortable to watch. We operate under relentless scrutiny. Every decision, invoice and governance choice must withstand inspection. Non-compliance is not shrugged off as a misunderstanding. It carries consequences.

Yet here we have a government apparently prepared to test how far it can ignore the very transparency rules it enforces on everyone else.

That is not a minor procedural failure. It is institutional arrogance.

Freedom of Information only works if those in power accept that it limits them. When a government treats disclosure as optional, accountability collapses into performance.

This is not about party politics or personalities. It is about whether Scotland still believes that public office comes with duties, not just authority.

When the independent regulator has to ask the highest court in the land to compel basic compliance, the problem is not the paperwork.

The problem is power that has grown too comfortable with being unanswerable.

And once a government decides the rules do not apply to it, trust is not eroded gradually.
It breaks.
