As a lawyer, knowing the law is not enough. You must pay close attention to detail and critically examine things that appear routine or harmless. Otherwise, you can easily become a tool for dubious actors.
Last week, at a police station, the IPO wanted access to my client’s premises to inspect the subject matter of a dispute. When I insisted on a search warrant, he left for about 30 minutes and returned claiming one was ready. I asked to see it. He showed it from a distance while I finished drafting a reply to the complainant’s petition. When I finished, I insisted on examining it properly.
The document was formatted as if issued by a Chief Magistrate’s Court, yet at the bottom it bore the signature and seal of the DPO. I immediately objected to its execution. The IPO threatened that they would enter the premises regardless. I told them to proceed and left. For reasons unknown to me, they later aborted the plan.
Four days later, the IPO called to say a proper search warrant had been obtained. This time, it was genuine. he even showed me the supporting affidavits and court processes. That was clearly what he had been trying to avoid the first time.
Had I not carefully examined the fake warrant, it would likely have been executed to my client’s disadvantage. These are the kinds of practical lessons law school does not teach; you learn them through experience.
