🚨 CONSIDER BANKERS AS PUBLIC SERVANTS

The Bombay High Court, Nagpur Bench, has held that bank employees do not fall within the definition of “Public Servant” under Section 21 of the IPC and therefore Section 353 IPC cannot be invoked merely because the victim is a bank employee.

Bankers handle public money,comes under essential services, serve citizens/public and implement Govt schemes.

Our Demand: Recognise Bank Employees as “Public Servants” and ensure effective legal protection against assault, threats and obstruction while on duty.

National Organisation of Bank Officers (NOBO) Joint Secretary Satish Shetty highlighted the strength of the Bharatiya Mazdoor Sangh (BMS) in opposing bank privatisation, recalling its 35,000-strong mobilisation in November 2022. He also spoke about BMS efforts to achieve 5-day banking and pursue the labour codes issue, while urging bank unions to maintain unity and avoid steps that could create hurdles in resolving key issues affecting bankers.

Bombay High Court has said that Bank Employees are not government employees. A customer attacked SBI employee. The employee filed FIR under Section 353. Under this section, only government employees can file FIR. The court said Bank employees are not government employees and thus the FIR under section 353 is not valid.
