#December6th marks a sad day in India's history. A day when right-wing goons, incited by prominent leaders from the BJP, demolished the 16th-century Babri Masjid- a criminal and illegal act, as held by Supreme Court. It is also an important day to remember what the Court noted in its 2019 Ayodhya judgment and to reflect on whether it is following its own saying after five years-
โWhen I asked the first Supreme Court judge about the verdict, they remarked with a hint of resignation, โWould any other judgment be acceptable in this country?โ
The judgment had also devoted ten pages to the Places of Worship Act, 1991, a law prohibiting the conversion of any place of worship and mandating the preservation of their religious character as of 15 August 1947โexcept in the Ayodhya case.
โHistorical wrongs cannot be remedied by the people taking the law in their own hands,โ it declared. โIn preserving the character of places of public worship, Parliament has mandated in no uncertain terms that history and its wrongs shall not be used as instruments to oppress the present and the future.โ (Justice Chandrachud authored this judgment)
But Chief Justice Chandrachudโs later handling of the Gyanvapi mosque case undermined this principle and opened a fresh chapter that would reignite communal tensions. The Gyanvapi case involved Hindu plaintiffs seeking worship rights within the mosque in Varanasi. Despite the Places of Worship Act, Chandrachud allowed a controversial scientific survey of the mosque to take place in August 2023. โWhat is frivolous to you is faith for the other side,โ he told the mosqueโs counsel Huzefa Ahmadi. An earlier videographic survey purportedly found a โshiv lingam,โ although Muslims claimed it was a fountain.
At another hearing in October 2023, Chandrachud would say, โThe Act says you canโt alter or convert nature of place. Theyโre not seeking conversion of the place. The question is what is the status of place as on August 15, 1947.โ
โThe law mandates freezing the character of a religious place as on Independence,โ the legal scholar, @ProfFMustafa, told me. โNow his bench says, โWhat is the character on August 15, 1947, we will decide.โ This is completely against the legislative intent.โ
Chandrachudโs decisions have spurred a wave of litigation challenging the status of mosques across India. Today, he is slated to deliver a lecture on โfraternity and inclusivityโ at the Kerala High Court. We must ask ourselves, what rule of law? After 32 years, has anyone been punished for this grave criminal act?
