HE PROTECTED 54,000 DOCTORS. THE @NHS PROTECTED ITSELF.

In January 2014, Dr Chris Day (@drcmday) was working overnight in the intensive care unit at Queen Elizabeth Hospital in Woolwich. Two locum doctors didn't show up. The unit was running at double the patient load the national guidelines allow. He raised the alarm. He reported unsafe staffing. He linked the situation to two patient deaths.

That's what the NHS calls a whistleblower.

What followed was eight years of litigation, a legal battle all the way to the Court of Appeal, and over £700,000 of public money spent by Health Education England (@NHSE_WTE) and Lewisham and Greenwich NHS Trust (@LG_NHS) trying to stop his case being heard at all.

Here's the really elegant bit. HEE's opening legal argument wasn't that they'd done nothing wrong. It was that whistleblowing law simply didn't apply to them, because they didn't directly employ junior doctors. They were just the organisation that controlled the career progression of every single one of England's 54,000 junior doctors. Totally different thing.

Dr Day fought that argument to the Court of Appeal and won. The law was clarified. All 54,000 junior doctors below consultant grade in England now have statutory whistleblowing protection. One man, crowdfunding against three QCs, changed employment law for an entire profession.

No formal apology from the NHS. No reinstatement. No path back to a consultant career. He has worked as a locum A&E doctor ever since, doing overnight shifts while his opponents collected salaries, pensions, and the occasional glowing tribute to NHS transparency.

During the 2022 tribunal hearing, the communications director at Lewisham and Greenwich NHS Trust deleted up to 90,000 emails. The director whose entire NHS email archive was also deleted during live litigation happened to be the instructing legal client in the case. The tribunal described the conduct as extraordinary. Nobody was prosecuted. The trust issued a partial apology about a press release.

The system did exactly what it always does. It absorbed the cost, deflected accountability, and waited for the man it destroyed to run out of money or energy.

He hasn't.

Protect the Wild has just uncovered a secret government review that has been happening behind closed doors. In January, DEFRA launched a review to look at the latest science on bovine TB (bTB) control, with findings due in June. But instead of choosing independent experts, officials under Minister Daniel Zeichner have filled the panel with people who have spent years pushing for badger culling.

This is yet another example of vested interests corrupting decision-making at the highest levels. The recommendations from this review will be handed to the discredited BTB Partnership, a group dominated by livestock farmers, industry vets, and other pro-cull advocates.

We already fought off Rishi Sunak’s sham consultation in March—thanks to public pressure, that was thrown in the bin. But now Labour is still allowing culling to continue in the so-called Low Risk Area, under pressure from the very same officials who pushed mass badger culling under the Tories. This must end.

DEFRA’s Panel: A Conflict of Interest Scandal
One name at the centre of this latest review? Professor Charles Godfray of Oxford University, who has been reappointed to examine bTB science—despite his long history of backing badger culling.

Godfray was previously involved in the 2018 government review on bTB, which led to continued badger culling under Michael Gove. His colleague Cristl Donnelly, who co-authored work justifying culling in 2013, has stepped back from being reappointed this time—perhaps sensing the controversy.

But that hasn’t stopped DEFRA from stacking the panel with academics who have previously supported culling, including statistician Bernard Silverman, another Oxford-based researcher, tasked with checking the work of his own university. While it may be too strong to definitively label Silverman as "pro-cull," his position within the same department as Donnelly raises potential concerns about conflicts of interest.

This is Oxford University marking its own homework. A sham. A total farce.

I have to report that I have not been re-elected as General Secretary of the FBU.

I am proud to have led the Fire Brigades Union for two decades, a period which has seen eight Prime Ministers. We have fought back against attacks on the fire service and we have laid the ground for real progress.

Much of the FBU’s work in that time is only now coming to fruition. For the first time in more than twenty years, we should soon see national standards in the fire service, and the FBU is able to play its role in advising ministers directly on fire service policy.

Because of our campaigning, and that of other unions, we are also likely to see the biggest workers’ rights package in recent years, including the repeal of anti-union laws that sought to ban effective strike action in our sector.

By mobilising and winning an overwhelming mandate for industrial action, the FBU has won a 16% pay rise over the past three years, with no strings attached. We have also had significant progress on maternity pay and the retaining fee for RDS firefighters.

I am proud to have led the longest period of strike action in our union’s history, over pensions, in 2013-15. Our legal fight on pensions has won many millions for firefighters and £19bn for workers across the public sector.

Our DECON campaign has changed the conversation in our sector about fire contaminants.

The FBU has played a leading role in the fight for equality, in the face of some appalling behaviours and a systemic failure by fire service leadership. This work has meant having difficult conversations inside our union and must be continued.

I leave the FBU with my head held high. Since the age of 16 I have been an active anti -racist, anti-fascist. I became a socialist as a teenager and I have been a trade unionist all my working life. My views and values have not changed and I will continue that fight.
