IBAC Operation Richmond has finally released its long overdue report, no findings of corruption can be made due to IBAC’s terms of reference.

"IBAC found that as a result of an undisclosed deal that the government made with [Secretary of the UFU Victoria Branch] Peter Marshall, to the exclusion of other key stakeholders, the government placed itself in a position where Mr Marshall was able to exert extraordinary influence over the negotiations for both the CFA EBA and the MFB EBA."

IBAC found he 'misled'
colleagues at CFA by failing to disclose a secret deal negotiate with Marshall. Jennings alleged referred to this as his "secret mission" or "secret business",
IBAC was told.

In her evidence, Jane said ahead of the ERSC ( Expenditure Review Sub-Committee of Cabinet) meeting she refused to co-sign the Cabinet submission because she could not in good conscience endorse an agreement which was opposed to what she swore in her Ministerial oath – to act in the interests of the Victorian people and good governance.

“IBAC found Andrews authorised Jennings, with the assistance of Tony Bates – a deputy secretary at the Department of Premier and Cabinet – to negotiate the CFA deal directly without the knowledge of the CFA itself.”

“While in negotiations on 11 April 2016, Minister Jennings referred to being ‘off doing my secret mission’ and ‘secret business’ in text messages to staff in his office and the PPO [Premier’s Private Office],” the report said.”

“In an intercepted phone call from 2019, Marshall summarised the meetings, telling a ministerial adviser the pay deal “was negotiated with f---in’ Jennings in a back room. It was endorsed by f---in’ Andrews and cabinet.”

“A key concern among those who did not support the deal were clauses that required the CFA to “consult and agree” with the UFU on decisions before they could be made.

They became known as “veto clauses”, which effectively allowed the union to increase its control of the CFA by blocking policies it did not agree with.”

The players may not be guilty under the current legislation but Victorians can show their disgust with this past its use by date government at the polling booths on 28th November.
