How writing off a $240,000 G-Wagon,
plays out in reality:
Let’s rewind the clock to December 2021.
You are looking for a last minute tax deduction,
and stumble across an appealing TikTok video suggesting you can buy an SUV >6k lbs and 100% write off the cost.
So you head down to the dealership and plop $240,000 down on a brand new G-Wagon.
(The AMG version, of course).
You are in the 37% tax bracket and pay 5.75% at the state level, so the deduction will save you $102,600 in taxes.
You tell your tax advisor, they sign off on it, and life moves on.
But in 2023, you decide to sell it.
You don’t need a business vehicle anymore and the G-wagon doesn’t meet your personal needs.
Sales price = $190,000.
Before you sell, you chat with your tax advisor.
You’re shocked to learn you’ll owe taxes on the sale.
Specifically, $81,255.
You’re kind of bummed to realize your net tax savings was only $21,345 (between taxes saved on purchase and owed on sale),
and further, the car’s actual value declined $50,000.
You realize you lost $28,655 on this transaction overall.
Honestly, that’s not too bad on a business vehicle.
But you still have a problem:
The $81,255 in unexpected taxes.
So you start exploring how to mitigate it.
You could buy a new business vehicle to do the whole write off thing again. The deduction on the new vehicle will mitigate or eliminate the $190k gain from the sale of your old G-Wagon.
But you really don’t need a new business vehicle.
And knowing you’ll be right back here in 2-3 years, you pass.
As you sit in your morning ice bath, ingenuity strikes!
What if I just move the G-Wagon from the business to myself?
Surely, that would avoid this tax issue.
Your accountant explains that, unfortunately, because you are an S-Corp, such distribution would be considered a taxable sale.
Drats.
Eventually, you just decide to sell it.
Take the tax hit on the chin and move on.
Nobody talks about this scenario when hyping up writing off a vehicle, but it is common.
Further,
Some of you will be unlucky and face an IRS audit.
The IRS can audit a 2021 tax return all the way into 2025.
You might not even own the vehicle anymore!
Yet if you can’t substantiate how you used the vehicle for business, you’ll be facing an absolute mess.
And the substantiation requirements are intense (see Frederick v. Commissioner for a good example of how a taxpayer was denied deductions related to his Aston Martin).
Back taxes, penalties, interest (now 8%).
Writing off a vehicle is a hassle.
Sometimes, the hassle is worth it.
But if you are an entrepreneur who rarely uses a vehicle and just looking for a tax deduction, I’d look for other ways to mitigate taxes.
In the next 5 years, over 50% of boomer businesses will SHUT DOWN instead of selling...
This creates a massive opportunity… if you’re ready to act on it.
