3. TO WHOMSOEVER IT MAY CONCERN / GENERAL PUBLIC
SUBJECT: LEGAL NOTICE DEMANDING CEASE & DESIST, IMMEDIATE TAKEDOWN OF UNLAWFUL DIGITAL CONTENT, PUBLIC RETRACTION, AND INITIATION OF PROCEEDINGS UNDER THE BHARATIYA NYAYA SANHITA (BNS), 2023 AND THE INFORMATION TECHNOLOGY ACT, 2000.

1. THAT recently, a digital broadcast / video recording was published and circulated on social media platform Instagram at (URL-https://t.co/23wqH3iWHY),featuring you, the unidentified Noticee (Jane Doe).

1.1 THAT in the aforementioned video broadcast, you have publicly uttered, performed, and disseminated statements/actions that are defamatory, inciting public mischief, & outraging public sentiments , hereby causing grave injury to public peace .

2. Your acts and public utterances attract strict criminal liability under BNS, 2023, specifically under:
   a) Section 351 (Criminal Intimidation);
   b) Section 353 (Public Mischief & Incitement to commit offenses against public tranquility);
   c) Section 356 (Defamation & Damage to Reputation);
   d) Section 299 / 196 (Outraging religious sentiments / Promoting enmity between classes, if applicable).

2.1 The electronic transmission and public hosting of the impugned content violates Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, imposing a mandatory duty on platform intermediaries to disable access to objectionable digital material.

In light of the statutory breaches detailed above, you are hereby called upon to comply with the following requisites within SEVEN (7) DAYS from the date of this Notice:
A. CEASE AND DESIST- Immediately cease and desist from making, publishing, or propagating similar illegal, inflammatory, or defamatory statements/videos across any digital medium.

B. TAKEDOWN AND DELETION - Ensure the immediate deletion and permanent takedown of the impugned Reel (URL: https://t.co/23wqH3iWHY)from Instagram and all mirror platforms.

C. PUBLIC APOLOGY / RETRACTION- Issue an unconditional public apology across official digital channels acknowledging the improper nature of the broadcast and expressing regret.

TAKE NOTICE that if you fail to strictly comply with the terms of this Legal Notice within the stipulated period of 7 (Seven) days, it shall be constrained to initiate appropriate civil and criminal proceedings against you—including filing a formal First Information Report (FIR) under the relevant provisions of BNS, 2023 read with Section 66 of the IT Act, 2000, alongside seeking direction from the competent Judicial Magistrate under Section 175(3) of BNSS, 2023—entirely at your risk, cost, and legal consequences.

A copy of this Notice is retained in my office for future legal records and evidentiary reliance under Section 63 of the Bharatiya Sakshya Adhiniyam (BSA), 2023.

In light of the recent public statements and administrative commitments concerning the blanket withdrawal or quashing of First Information Reports (FIRs) related to the agitations led by the CJP and associated acts of public disorder, our Clients wish to assert their legal rights and standing. They vigorously oppose any such executive concessions or applications filed pursuant to Section 360 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (formerly known as Section 321 of the CrPC).

It is well-established in law that the withdrawal of criminal prosecution cannot be permitted as a mere political compromise or executive leniency in cases involving cognizable offenses such as public violence, obstruction of public servants in the line of duty, and disturbance of public peace. Consequently, our Clients will be submitting appropriate Intervention Applications and Impleadment Petitions to the competent jurisdictional Courts. They aim to demonstrate that any unilateral withdrawal of prosecution threatens the rule of law, and the dismissal of such criminal proceedings without judicial review would be entirely illegitimate, legally unsound, and against the public interest.
