For each case, a federal court (including the Supreme Court) asks: (1) Who should decide? and (2) If it's the federal judicial branch, what should the decision be? We the People should pay more attention to the first question.

@baseballcrank@NRO This is the right result in this case. Do you think that the doctrine should be eliminated altogether? If a court accepts your argument, you can't reverse yourself later (in the same case). Seems like common sense. What about other equitable (judge made) doctrines?
