He can’t get a harsher sentence if he’s tried and convicted again - otherwise defendants would effectively be punished for exercising their constitutional right to an appeal.
My Judge Copenhaver story: I only appeared before the man once in person. @deepakguptalaw sued and I represented the defendants. I filed a Rule 12 motion and Judge Copenhaver had us come to chambers to discuss. We were invited into his conference room and sat around a large table where Judge Copenhaver showed a mastery of the legal and factual issues involved in the case. At that time, he was in his mid 90s. But he was still as sharp as a tack. He did show that he was from a different era with one of his questions, but that entire case was the perfect example of how a good jurist and professional counsel can (and should) litigate a case.
Eternal rest grant unto him O Lord, and may perpetual light shine upon him. May his soul, and the souls of all the faithfully departed, through the mercy of God, rest in peace.
Something I’ve noticed over time:
As people rise in social status, they start filtering who they respond to, how quickly they respond, and how open they are, largely based on the other person’s status.
And that bar keeps moving.
The people who made the cut six months ago suddenly don’t anymore as their own status rises.
Texts go unanswered, calls don’t get returned, and access changes.
Eventually, their entire circle becomes a reflection of status, and not character. Without shared values or real connection - just proximity to perceived importance.
At some point, you’re no longer choosing people. You’re choosing status.
And the reality is, the same people you chose for their status are doing the exact same thing.
The second yours slips, they’re gone.
And then, who’s left?
This is often said but is wrong. Although it may be true in the novus order, some Eastern Catholic rites do have Mass during this time. For example, the Melkites have Mass on Saturday morning. Even Roman Catholics using the pre-55 books have Mass Saturday morning.
