It is now clear as day that in cases of political nature, there is a synchronized, choreographed coordination between the Ugandan judiciary (some judges, magistrates, registrars, prosecutors), the torturous military state, and the Ugandan police to defeat non-derogable rights (freedom from torture, fair hearing, and the right of habeas corpus).
The evidence is abundant - a person is abducted in broad daylight, on camera, with selected media houses in tow, held incommunicado, and tortured. His lawyers apply to court for a writ of habeas corpus; all state organs deny holding the individual. The courts offer no remedy.
Then suddenly, the individual is ‘dumped’ at a police station, charge sheet ready and a judicial officer waiting to send them to prison -denying them bail on flimsy reasons.
These prosecutors, judicial officers, and security officials must know that they too will one day need the protection of the law. Acquiescing in violating the law and the dignity of fellow citizens is a moral and legal failing that will consume you all too. Know that we know you.
Most Ugandans knew that, unless the sun rose from the West, Okello Onyum was likely to be convicted over the murder of the Ggaba children. Yet the State still accorded him a largely transparent, public and fair trial.
Why, then, can Dr Kizza Besigye not be given the same? Why was Martha Karua stopped from representing him? A trial conducted without fairness, transparency and meaningful legal representation is a trial in name only. It is wrong, and every Ugandan should be concerned.
