Jocelyn Benson says an audit 'affirms' our voter rolls are secure all while the Auditor General DECLINED to make that same conclusion.

❌ 18,523 registered voters flagged as noncitizens.
❌ 2,582 voting records tied to people recorded as deceased before Election Day.
❌ 154,000 address changes misreported as new voter registrations.

The only thing we can 'affirm' is that Jocelyn Benson can't secure our elections, can't run her department and has absolutely no business running our state.

709,841 signatures of the 446,198 needed were submitted to prevent illegals from voting in Michigan. Currently 1,000 are pulled to sample and Benson claims we were 3 short to qualify to go on the November 3rd ballot. How many should the Secretary of State pull to sample to verify the validity of the signatures and should there be witnesses from the petition sponsors to witness the pulling of the sample?

THEY WON’T DEFEND IT: Michigan Secretary of State Jocelyn Benson created a new rule ordering clerks to destroy election records. My client sued because it forces her to break federal law. Benson filed twenty-three pages trying to get the case thrown out, and NOT ONE ARGUMENT to say her rule is legal.

Read it yourself. Their brief tells the court that their own Director of Elections “cannot offer a substantive argument in response to Plaintiff’s complaint without tipping his hand.”

And this: "it remains to be seen whether Defendants will have the same legal position regarding the rule."

They have previously argued that the rule violates no law, including the federal statute. They just won’t say it to a judge here in Michigan.

So what did they try to argue?

That she WAITED TOO LONG, in a case filed EIGHT DAYS after the election, after asking them TWICE to clarify the rule, the first time last fall.

That any determination about Benson’s rule belongs in a “process” run by the department my client sued.

Never once in twenty-three pages did Benson argue a clerk can DESTROY federal election records in seven days when federal law says KEEP them twenty-two months.

That is the ENTIRE CASE. Twenty-three pages from Benson on why a judge shouldn’t answer this important legal question, and NOTHING on what the answer is.

Our response went in yesterday afternoon to the judge. The RNC filed an amicus brief as well.

And their own sworn affidavit says they still want to send election record destruction “guidance” to Michigan's 1,500 local clerks later this week.

Michigan Rep Rachelle Smit “I took off a dead voter in my township and guess what? That dead voter was put back on”

“There was a family member who at one point was registered at my in-laws home, and that family member had died nearly 20 years prior. They were put on the rolls — They were mailed voter application ballots without the authorization”

Michigan’s voter rolls were identified to have tens of thousands of dead voters

- 95% of the dead voters are marked active
- 23,663 had been dead for 5 years or more
- 17,479 had been dead for at least 10 years
- 3,956 had been dead for at least 20 years
- At least two registrants were born before 1921, making them over 100 years old

The investigation also showed that 95% of dead voters were identified as being marked as “Active.” Meaning they are being sent mail in ballots
