If Graham's bill is as advertised, we should be clear that this is actually a blue state abortion ban. The vast majority of red states already have bans stricter than this one. So the point here is really only to overrule the laws of blue states that protect abortion rights.

@AshaRangappa_ Almost seems like he’s trying to usurp the power of the executive branch to classify/declassify for the judicial branch, if I’m understanding his side’s argument correctly. I wouldn’t think that would hold up on appeal.

Trump claims docs are in 2 categories: Presidential records and personal. Wrong. 3rd category is govt records that are not presidential records (eg agency records). And he has no right to return of presidential records, govt records, or personal recs covered by Search Warrant.

Trump concedes the Govt national security review can use criminal tools, but ignores that those tools can only legally be used if they are furthering at least in part a criminal investigation. Otherwise it would be improper. So like Trump to not care about, or focus on, this.

Trump submission implies he declassified docs but does not come out and say it. Any fair-minded judge [insert comment here about Cannon] would ask Trump's counsel what they mean by putting the term classified in quotations -- is Trump saying he declassified the docs or isn't he?

What a silly dance. If Trump really thought he had declassified the documents, he & his lawyers would have said so. The fact that they never say in Court what they say outside of Ct is itself damning

DOJ and the Judge have given them many opportunities to say so, they never do.
