URGENT. A veteran may be forced to sell his property for child support arrears which he does not owe & has evidence he does not owe these fictitious arrears. Shakespeare Martineau (representative of the CMS) is aware that their client - the Child Maintenance Service is acting in bad faith yet they are still proceeding with a forced sale knowing the debt is in dispute. An appeal has been applied for, to have the void liability order set aside.

The Child Maintenance Service has been adding costs and interest on to the liability order which is unlawful, the CMS is ignoring case law which they are supposed to apply in this case Donaghy v DWP 2018 EWFC B73

The veteran has children who stay with him therefore the Child Maintenance Service is in breach of their statutory duty - section 2 of the Child Support Act 1991  - Welfare of children: the general principle
Where, in any case, which falls to be dealt with under this Act, the Secretary of State or any child support officer is considering the exercise of any discretionary power conferred by this Act, he (shall) have regard to the welfare of any child likely to be affected by his decision.

The CMS and Shakespeare Martineau are forcing the sale of the property for a debt that is not owed - the forced sale of the property will be for around £260,000 when the property is worth £350,000. Once the property has been taken the Child Maintenance Service will no doubt put the property back on the market for full value or sell it to one of their friends - this is criminal conversion. This needs to be reported to the Police.

As we can see here it is very clear that the Child Maintenance Service does not have the best interests of any child at heart as politicians and Gingerbread state. This is a SCANDAL far bigger than the Post Office Scandal.

What sickens me is how good parents (most often but not always dads) are blocked from seeing their kids due to so called “safeguarding concerns raised by a bitter ex partner while we see actual terrible parents left to be dangerous just because they are not separated parents
