Can Ritabrata Banerjee’s Appointment as Leader of the Opposition Survive Judicial Scrutiny?

The Supreme Court’s judgment in Subhash Desai vs Principal Secretary, Governor of Maharashtra & Ors. (11 May 2023) contains an observation that may have significant relevance to the ongoing controversy in the West Bengal Legislative Assembly.

In its conclusions (d), the Court stated:

“The political party and not the legislature party appoints the Whip and the Leader of the party in the House.”

This principle was laid down while adjudicating the Shiv Sena dispute, where the Court distinguished between the authority of the political party and that of the legislature party.

Viewed in that context, the developments in West Bengal raise an important legal question. The Trinamool Congress, as a political party, communicated its decision to appoint Sobhandeb Chattopadhyay as Leader of the Opposition and Firhad Hakim as Chief Whip. The Speaker, however, did not accept that communication citing alleged irregularities. Instead, recognition was reportedly extended to Ritabrata Banerjee based on the support of a section of the legislature party, despite his expulsion by the political party.

If the principle laid down by the Supreme Court in the Shiv Sena case is applied here, then the decisive authority appears to rest with the political party rather than with a faction or majority of the legislature party. Under that interpretation, the appointment of Ritabrata Banerjee as Leader of the Opposition becomes legally questionable.

Whether the facts of the two cases are ultimately identical is a matter for the courts to decide. However, the Supreme Court’s observation seems to strengthen the argument that the power to choose the Leader of the House belongs to the political party and not to the legislature party acting independently of it.
