An employer has been ordered to pay an employee KSh 1 million for forcing female workers to remove their innerwear during an unlawful "menstrual verification" exercise.

The shocking incident happened after a used sanitary towel was found in a workplace bin. About 35 female employees were allegedly ordered by senior HR and Quality Assurance officers to expose their undergarments so the company could identify who was menstruating.

The Employment and Labour Relations Court ruled that the exercise was unconstitutional, inhuman and degrading, and held the employer liable despite claims that the officers acted on their own. The Court found that the employees' rights to dignity, privacy and fair labour practices had been violated, and awarded the petitioner KSh 1 million in compensation.

A Kenyan court has just delivered a landmark ruling in a medical negligence case that dragged on for almost two decades.

Naila Qureshi sued Dr Raffique Parker and two others over a hysterectomy procedure done back in 2006.

She says the doctor removed her cervix without her consent, and botched the operation so badly that it caused a vesico vaginal fistula.

The damage cost her her job and her ability to earn a living.

Her husband also joined the suit, citing loss of conjugal life and years of suffering.

Justice Alexander Muasya Muteti found the 1st and 3rd defendants grossly negligent.

The hospital was faulted too, for letting a doctor who had been disbarred in Uganda practice on Kenyan patients.

In the end, the court awarded the family a staggering Kshs 157,207,524.20 in damages.

It is one of the biggest medical negligence payouts ever ordered by a Kenyan court.
