THE PEOPLE MUST NOT REPAY ILLEGAL DEBT
Kenya’s people cannot be made to repay every loan simply because someone signed a document in the name of the Republic.
Before taxpayers are asked to pay, we must ask basic questions: Was the borrowing lawful? Were the constitutional and statutory procedures followed? Where did the money go? What was it used for? What public benefit did it produce?
And where #odiousdebt is alleged, we must ask what the lenders knew, or reasonably ought to have known.
Public debt is not a blank cheque. The Constitution, the law and the Kenyan people must come first.

There’s a reason they won’t push this as Grand Coalition, because they know very well this is the kind of coalition that has the potential to serve Kenyans, not their interests.
A Maraga, Omtatah and Sifuna led government has the potential to right so many wrongs in this country. That is exactly why the conversation will quickly shift to who can bring votes, who has numbers and who is “electable”, not because they care about Kenya but because they need politicians they can control and who will protect the very system that has looted this country for decades.
This idea that we need Person A, B or C because they will “bring votes” needs to end.
Go out there and campaign for the candidate you believe in, talk to your family, talk to your cousins, talk to your grandparents, form groups, have conversations, convince people… this is how democracies are won.
No one has a monopoly on votes in this country. As someone once said, THE VOTER IS THE KINGMAKER!!
Why are we waiting for the same political class that helped ruin this country to tell us which direction Kenya should take? Until we understand that the opposition is not a group of wealthy politicians fighting each other but you, the people, demanding better leadership, we will keep surrendering our power to those who have never had our interests at heart.

They cut down the acacia trees this week at Kenyatta National Hospital. The marabou storks that had nested there for decades didn’t have anywhere to go😭😭😭. Some died. Some got injured. All because nobody thought to check what was living in those branches first.
This is what happens when “development” skips the wildlife-sensitivity conversation entirely. Nairobi keeps growing, but does it have to keep growing over everything else that was already here?

PUBLIC MONEY IS NOT EXECUTIVE PROPERTY: THE CONSTITUTIONAL TRUTH ABOUT CHAPTER TWELVE
Fellow Kenyans,
The bottom line of Chapter Twelve is simple: the Executive DOES NOT own public money, THE PEOPLE do.
Our 2010 Constitution intentionally strips the President and Cabinet of unchecked power over your taxes through six strict principles:
1) People Own the Funds: Government only administers public money; it never owns it.
2) Parliament Approves Spending: The Executive cannot spend a single shilling without explicit parliamentary authority.
3) The Treasury is Independent: Under Article 225, the Treasury is an autonomous custodian, not a political department subordinate to the Executive.
4) Independent Oversight: The CRA, Controller of Budget, and Auditor-General ensure no single entity controls the financial chain.
5) Personal Liability for Looting: Under Article 226(5), any official who directs unlawful spending must pay it back from their own pocket, even after leaving office.
6) No Free-For-All Borrowing: Debt is strictly tied to legitimate budget deficits, not executive whims.

Former Migori Governor Okoth Obado’s conviction for the brutal murder of Sharon Otieno is a searing indictment of how power, patriarchy and impunity have operated in our politics for years.
For nearly eight years, Sharon’s family, women’s rights defenders and journalists were forced to relive her abduction, the terror she endured and the discovery of her body in a forest, all while a powerful governor insisted this was mere suspicion. Yesterday’s verdict affirms that the law can, and must, pierce the armour of political office.
This judgment should now open the door for more unresolved cases to move from files to finality. Justice cannot stop with Sharon, it must extend to Baby Pendo, Albert Ojwang and thousands of other Kenyans whose lives were cut short through abuse of state power.
Justice for Sharon therefore means strengthening investigations, speeding up trials and dismantling the cultures that shield perpetrators when victims are poor, young or politically inconvenient. Each concluded case widens the path for families still waiting at mortuaries and court corridors for answers.
To every survivor and every bereaved family watching this case, your pain is real, but so is the Constitution. Our duty is to insist that no Kenyan death at the hands of power is too old or too political for accountability.
Sharon’s name must live not only as a warning to abusive power, but as a catalyst for a Kenya where state violence is met with immediate investigation, swift prosecution and zero tolerance.

Our Constitution was designed with one clear principle. No single political office should have unchecked control over public money. That is why it separates political leadership from the management of the country’s finances.
Article 225(1) establishes the National Treasury as the constitutional custodian of public finances. Its role is too important to be left to politics alone.
Yet Section 11 of the Public Finance Management Act places the National Treasury under the National Executive and under the authority of a political Cabinet Secretary.
This is not a small legal issue. It goes to the heart of constitutional governance.
Parliament has the power to make laws that implement the Constitution. It does not have the power to change the Constitution through an ordinary Act of Parliament.
When the independence of public financial management is weakened, the checks that protect taxpayers’ money are weakened too.
The Constitution must remain above politics. Every law passed by Parliament must respect it.
If we fail to defend Chapter Twelve today, we risk eroding one of the most important safeguards for accountability and responsible use of public resources.
The Constitution belongs to all of us. Defending it is a duty we all share.

I applaud the people of Ol Kalou, who endured intimidation with more courage than the state showed them protection, for standing firm.
Their ordeal in the face of this dictatorship has set the standard for popular resistance to electoral manipulation.
I have sat as Chief Justice of this Republic and adjudicated on what a free and fair election means. I will not now stand by and watch that standard be quietly buried ahead of the 2027 elections.
Ol Kalou was not a local contest. It is a rehearsal for 2027, and Kenyans must see it as such.
